SYNOPSIS AS INTRODUCED:

55 ILCS 5/5-1005.7 new

Amends the Counties Code. Provides that an ordinance or resolution that would result in the increase of revenue to a home rule county by an increase of any tax of that county may be adopted only with the concurrence of three-fifths of the members elected to the county board. Preempts home rule powers and functions. Effective immediately.

AN ACT concerning local government.

Be it enacted by the People of the State of Illinois, represented in the General Assembly:

Section 5. The Counties Code is amended by adding Section 5-1005.7 as follows:

(55 ILCS 5/5-1005.7 new)

Sec. 5-1005.7. Passage of revenue ordinances in home rule counties.

(a) An ordinance or resolution that would result in the increase of revenue to a home rule county by an increase of any tax of that county may be adopted only with the concurrence of three-fifths of the members elected to the county board.

(b) This Section is a denial and limitation of home rule powers and functions under subsection (g) of Section 6 of Article VII of the Illinois Constitution.

Section 99. Effective date. This Act takes effect upon becoming law.
