SYNOPSIS AS INTRODUCED:
 
220 ILCS 5/8-515 new

    Amends the Public Utilities Act. Provides that no account for a utility service by a public utility that serves over 2,000,000 residential customers shall be in the name of a person under the age of 18, unless that person is an emancipated minor. Provides that such a utility is not entitled to any payment on a service account transferred into the name of a person under the age of 18, unless that person is an emancipated minor. Provides that any utility that serves over 2,000,000 residential customers that unknowingly opens a service account in the name of or transfers a service account to a person under the age of 18 who is not an emancipated minor and reports a delinquent debt on the account to a credit reporting agency, collection agency, or person licensed to market utility services in the State of Illinois shall request that the delinquent debt report on the service account be removed from the minor's credit history as soon as possible after the utility discovers the error.

1     AN ACT concerning regulation.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Public Utilities Act is amended by adding
5 Section 8-515 as follows:
 
6     (220 ILCS 5/8-515 new)
7     Sec. 8-515. Prohibition against a utility account in a
8 minor's name.
9     (a) No account for a utility service by a public utility
10 that serves over 2,000,000 residential customers shall be in
11 the name of a person under the age of 18, unless that person is
12 an emancipated minor.
13     (b) A utility that serves over 2,000,000 residential
14 customers is not entitled to any payment on a service account
15 transferred into the name of a person under the age of 18,
16 unless that person is an emancipated minor.
17     (c) Any utility that serves over 2,000,000 residential
18 customers that unknowingly opens a service account in the name
19 of or transfers a service account to a person under the age of
20 18 who is not an emancipated minor and reports a delinquent
21 debt on the account to a credit reporting agency, collection
22 agency, or person licensed to market utility services in the
23 State of Illinois shall request that the delinquent debt report
