SYNOPSIS AS INTRODUCED:

    Amends the Illinois Low-Level Radioactive Waste Management Act. Requires the Department of Nuclear Safety's forms and rules to be developed and adopted after a site is established. Effective immediately.

1     AN ACT concerning nuclear safety.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Illinois Low-Level Radioactive Waste
5 Management Act is amended by changing Section 9 as follows:
 
6     (420 ILCS 20/9)  (from Ch. 111 1/2, par. 241-9)
7     Sec. 9. Requirements for waste transporters.
8     (a) No person shall transport any low-level radioactive
9 waste to a storage, treatment or disposal facility in Illinois
10 licensed under Section 8 without a permit granted by the
11 Department.
12     (b) No person shall transport any low-level radioactive
13 waste to a storage, treatment or disposal facility licensed
14 under Section 8 without a manifest document. The Department
15 shall develop the form for such manifests and shall promulgate
16 rules and regulations establishing a system of tracking wastes
17 from their point of generation to storage, treatment, and
18 ultimate disposal.
19     (b-5) Upon establishing a site, the Department shall
20 develop the form for such manifests and shall promulgate rules
21 and regulations establishing a system of tracking wastes from
22 their point of generation to storage, treatment, and ultimate
23 disposal.

1     (c) Each application for a permit under this Section shall
2 contain any information as may be required under regulations
3 promulgated by the Department, including, but not limited to,
4 information respecting:
5         (1) The estimated quantities and types of wastes to be
6     transported to a facility located in Illinois;
7         (2) The procedures and methods used to monitor and
8     inspect the shipments to ensure that leakage or spills do
9     not occur;
10         (3) The timetables according to which the wastes are to
11     be shipped.
12         (4) The qualifications and training of personnel
13     handling low-level radioactive waste; and
14         (5) The use of interim storage and transshipment
15     facilities.
16     (d) The Director may issue a permit to any applicant who
17 has met and whom he believes will comply with the requirements
18 of the Illinois Hazardous Materials Transportation Act and any
19 other applicable State or federal laws or regulations. In the
20 event that an applicant or permittee proposes modifications of
21 a permit, or in the event that the Director determines that
22 modifications are necessary to conform with the requirements of
23 the Act, the Director may issue any permit modifications
24 necessary to protect human health and the environment and may
25 specify the time allowed to complete the modifications.
26     (e) The Department shall inspect each shipment of low-level

1 radioactive wastes received at the regional disposal facility
2 for compliance with the packaging, placarding and other
3 requirements established by rules and regulations promulgated
4 by the Illinois Department of Transportation under the Illinois
5 Hazardous Materials Transportation Act and any other
6 applicable State or federal regulations. The Department shall
7 notify the Attorney General of any apparent violations for
8 possible prosecution under Sections 11 and 12 of that Act.

10     Section 99. Effective date. This Act takes effect upon
11 becoming law.
