SYNOPSIS AS INTRODUCED:
 
New Act

    Creates the Drug Overdose Prevention Act. Authorizes the Director of the Department of Human Services Division of Alcoholism and Substance Abuse to publish an annual report on drug overdose trends statewide. Authorizes the Director to establish a program to provide for the production and publication, in electronic and other formats, of drug overdose prevention, recognition, and response literature and to provide advice to State and local officials on the growing drug overdose crisis, including the prevalence of drug overdose incidents, trends in drug overdose incidents, and solutions to the drug overdose crisis. Authorizes the Director to award grants to create or support local drug overdose prevention, recognition, and response projects; authorizes local health departments, correctional institutions, and community-based organizations to apply for the grants. Sets forth criteria for awarding grants. Effective immediately.

1     AN ACT in relation to health.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 1. Short title. This Act may be cited as the Drug
5 Overdose Prevention Act.
 
6     Section 5. Definitions. In this Act:
7     "Opioid antagonist" means naloxone hydrochloride or any
8 other similarly acting and equally safe drug approved by the
9 U.S. Food and Drug Administration for the treatment of drug
10 overdose.
11     "Department" means the Department of Human Services
12 Division of Alcoholism and Substance Abuse.
13     "Director" means the Director of the Department of Human
14 Services Division of Alcoholism and Substance Abuse.
15     "Health care professional" means a physician licensed to
16 practice medicine in all its branches, a physician assistant
17 who has been delegated the provision of health services by his
18 or her supervising physician, or an advanced practice
19 registered nurse who has a written collaborative agreement with
20 a collaborating physician that authorizes the provision of
21 health services.
 
22     Section 10. Reports of drug overdose.

1     (a) The Director may publish annually a report on drug
2 overdose trends statewide that reviews State death rates from
3 available data to ascertain changes in the causes or rates of
4 fatal and nonfatal drug overdose for the preceding period of
5 not less than 5 years. The report shall also provide
6 information on interventions that would be effective in
7 reducing the rate of fatal or nonfatal drug overdose.
8     (b) The report shall include:
9         (1) Trends in drug overdose death rates.
10         (2) Trends in emergency room utilization related to
11     drug overdoses and the cost impact of emergency room
12     utilization.
13         (3) Trends in utilization of pre-hospital and
14     emergency services and the cost impact of emergency
15     services utilization.
16         (4) Suggested improvements in data collection.
17         (5) A description of other interventions effective in
18     reducing the rate of fatal or nonfatal drug overdoses.
 
19     Section 15. Programs; drug overdose prevention.
20     (a) The Director may establish a program to provide for the
21 production and publication, in electronic and other formats, of
22 drug overdose prevention, recognition, and response
23 literature. The Director may develop and disseminate curricula
24 for use by professionals, organizations, individuals, or
25 committees interested in the prevention of fatal and nonfatal

1 drug overdose, including, but not limited to, drug users, jail
2 and prison personnel, jail and prison inmates, drug treatment
3 professionals, emergency medical personnel, hospital staff,
4 families and associates of drug users, peace officers,
5 firefighters, public safety officers, needle exchange program
6 staff, and other persons. In addition to information regarding
7 drug overdose prevention, recognition and response, literature
8 produced by the Department shall stress that drug use remains
9 illegal and highly dangerous and that complete abstinence from
10 illegal drug use is the healthiest choice and shall provide
11 information and resources for substance abuse treatment.
12     (b) The Director may provide advice to State and local
13 officials on the growing drug overdose crisis, including the
14 prevalence of drug overdose incidents, trends in drug overdose
15 incidents, and solutions to the drug overdose crisis.
 
16     Section 20. Grants.
17     (a) The Director may award grants, in accordance with this
18 Section, to create or support local drug overdose prevention,
19 recognition, and response projects. Local health departments,
20 correctional institutions, and community-based organizations
21 may apply to the Department for a grant pursuant to this
22 Section at the time and in the manner the Director prescribes.
23     (b) In awarding grants, the Director shall consider the
24 necessity for overdose prevention projects in various settings
25 and shall encourage all grant applicants to develop

1 interventions that will be effective and viable in their local
2 areas.
3     (c) The Director shall give preference for grants to
4 proposals that, in addition to providing life-saving
5 interventions and responses, provide information to drug users
6 on how to access drug treatment or other strategies for
7 abstaining from illegal drugs. The Director shall give
8 preference to proposals that include one or more of the
9 following elements:
10         (1) Policies and projects to encourage persons,
11     including drug users, to call 9-1-1 when they witness a
12     potentially fatal drug overdose.
13         (2) Drug overdose prevention, recognition, and
14     response education projects in jails, prisons, drug
15     treatment centers, outreach programs, and other
16     organizations that work with, or have access to, drug users
17     and their families and communities.
18         (3) Drug overdose recognition and response training,
19     including rescue breathing, in jails, prisons, drug
20     treatment centers, and other organizations that work with,
21     or have access to, drug users and their families and
22     communities.
23         (4) The production and distribution of targeted or mass
24     media materials on drug overdose prevention and response.
25         (5) Naloxone hydrochloride prescription or
26     distribution projects.

1         (6) The institution of education and training projects
2     on drug overdose response and treatment for emergency
3     services and law enforcement personnel.
4         (7) A system of parent, family, and survivor education
5     and mutual support groups.
6     (c) In addition to funds appropriated by the General
7 Assembly, the Director may seek grants from private
8 foundations, the federal government, and other sources to fund
9 the grants under this Section and to fund an evaluation of the
10 programs supported by the grants.
 
11     Section 99. Effective date. This Act takes effect upon
12 becoming law.
