Amends the Criminal Code of 1961. Creates the offense of copper burglary. Provides that a person commits copper burglary when, without the consent of the owner, he or she knowingly enters or remains upon any premises, easement, or right-of-way with intent to steal or remove, or aid or assist in stealing or removing, any copper or copper alloy, including without limitation any wire, cable, rod, or tubing. Provides that copper burglary is a Class A misdemeanor for a first offense, a Class 4 felony for a second offense, and a Class 3 felony for a third or subsequent offense. Effective immediately.

| AN ACT concerning criminal law.

| Be it enacted by the People of the State of Illinois,

| represented in the General Assembly:

| Section 5. The Criminal Code of 1961 is amended by adding | | 5 |
| Section 19-6 as follows:

| (720 ILCS 5/19-6 new) | | 7 |
| Sec. 19-6. Copper burglary. | | 8 |
| (a) A person commits copper burglary when, without the | | 9 |
| consent of the owner, he or she knowingly enters or remains | | 10 |
| upon any premises, easement, or right-of-way with intent to | | 11 |
| steal or remove, or aid or assist in stealing or removing, any | | 12 |
| copper or copper alloy, including without limitation any wire, | | 13 |
| cable, rod, or tubing. | | 14 |
| (b) Sentence. Copper burglary is a Class A misdemeanor for | | 15 |
| a first offense, a Class 4 felony for a second offense, and a | | 16 |
| Class 3 felony for a third or subsequent offense.

| Section 99. Effective date. This Act takes effect upon | | 18 |
| becoming law.
