SYNOPSIS AS INTRODUCED:

    Amends the Illinois Vehicle Code. Provides that an insurer that issues a liability insurance policy for a vehicle shall issue to the policy holder an insurance window sticker as evidence that the vehicle is covered by the policy. Provides that rules adopted by the Secretary of State shall prescribe that an insurance window sticker contain the same information as is required on an insurance card and shall require that reasonable measures be taken to prevent the fraudulent production of insurance window stickers. Provides that the insurance window sticker shall be permanently affixed to the lower left corner of the windshield of the vehicle. Provides that the display of a false insurance window sticker is a Class A misdemeanor. Provides that a person commits a Class 4 felony if he or she alters an invalid insurance window sticker to make it appear valid or knowingly makes, sells, or otherwise makes available an invalid or counterfeit insurance window sticker.

1     AN ACT concerning transportation.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Illinois Vehicle Code is amended by changing
5 Sections 3-710, 7-602, and 7-603 as follows:
 
6     (625 ILCS 5/3-710)  (from Ch. 95 1/2, par. 3-710)
7     Sec. 3-710. Display of false insurance card or window
8 sticker. No person shall display evidence of insurance to a law
9 enforcement officer, court, or officer of the court, knowing
10 there is no valid liability insurance in effect on the motor
11 vehicle as required under Section 7-601 of this Code or knowing
12 the evidence of insurance is illegally altered, counterfeit, or
13 otherwise invalid as evidence of insurance required under
14 Section 7-602 of this Code. If the law enforcement officer
15 issues a citation to a motor vehicle operator for displaying
16 invalid evidence of insurance, the officer shall confiscate the
17 evidence for presentation in court.
18     Any person convicted of violating this Section is guilty of
19 a Class A misdemeanor.

22     Sec. 7-602. Insurance card and window sticker. Every

1 operator of a motor vehicle subject to Section 7-601 of this
2 Code shall carry within the vehicle evidence of insurance. If
3 the evidence of insurance is an insurance window sticker, it
4 shall be permanently affixed to the lower left corner of the
5 windshield of the vehicle. The evidence shall be legible and
6 sufficient to demonstrate that the motor vehicle currently is
7 covered by a liability insurance policy as required under
8 Section 7-601 of this Code and may include, but is not limited
9 to, the following:
10         (a) an insurance card or window sticker provided by the
11     insurer under this Section;
12         (b) the combination of proof of purchase of the motor
13     vehicle within the previous 60 days and a current insurance
14     card issued for the motor vehicle replaced by such
15     purchase;
16         (c) the current declarations page of a liability
17     insurance policy;
18         (d) a liability insurance binder, certificate of
19     liability insurance or receipt for payment to an insurer or
20     its authorized representative for a liability insurance
21     premium, provided such document contains all information
22     the Secretary of State by rule and regulation may require;
23         (e) a current rental agreement;
24         (f) registration plates, registration sticker or other
25     evidence of registration issued by the Secretary only upon
26     submission of proof of liability insurance pursuant to this

1     Code;
2         (g) a certificate, decal, or other document or device
3     issued by a governmental agency for a motor vehicle
4     indicating the vehicle is insured for liability pursuant to
5     law.
6     An insurance card and window sticker shall be provided for
7 each motor vehicle insured by the insurer issuing the liability
8 insurance policy.
9     The form, contents and manner of issuance of the insurance
10 card and window sticker shall be prescribed by rules and
11 regulations of the Secretary of State. The Secretary shall
12 adopt rules requiring that reasonable measures be taken to
13 prevent the fraudulent production of insurance cards and window
14 stickers. The insurance card and window sticker shall display
15 an effective date and an expiration date covering a period of
16 time not to exceed 12 months. The insurance card and window
17 sticker shall contain the following disclaimer: "Examine
18 policy exclusions carefully. This form does not constitute any
19 part of your insurance policy." If the insurance policy
20 represented by the insurance card and window sticker does not
21 cover any driver operating the motor vehicle with the owner's
22 permission, or the owner when operating a motor vehicle other
23 than the vehicle for which the policy is issued, the insurance
24 card and window sticker shall contain a warning of such
25 limitations in the coverage provided by the policy.
26     No insurer shall issue a card or window sticker, similar in

1 appearance, form and content to the insurance card and window
2 sticker required under this Section, in connection with an
3 insurance policy that does not provide the liability insurance
4 coverage required under Section 7-601 of this Code.
5     Unless the evidence of insurance is an insurance window
6 sticker permanently affixed to the lower left corner of the
7 windshield of the vehicle, the The evidence of insurance shall
8 be displayed upon request made by any law enforcement officer
9 wearing a uniform or displaying a badge or other sign of
10 authority. Any person who fails or refuses to comply with such
11 request is in violation of Section 3-707 of this Code. Any
12 person who displays evidence of insurance, knowing there is no
13 valid liability insurance in effect on the motor vehicle as
14 required under Section 7-601 of this Code or knowing the
15 evidence of insurance is illegally altered, counterfeit or
16 otherwise invalid, is in violation of Section 3-710 of this
17 Code.
18     "Display" means (i) the permanent attachment of the
19 insurance window sticker to the lower left corner of the
20 windshield of the vehicle or (ii) the manual surrender of the
21 insurance card or other evidence of insurance into the hands of
22 the law enforcement officer, court, or officer of the court
23 making the request for the officer's, court's, or officer of
24 the court's inspection thereof.
