SYNOPSIS AS INTRODUCED:

65 ILCS 5/11-30-15 new

Amends the Municipal Code. Provides that a municipality may license residential rental property managers. Provides that the municipality may require the licensee to pay a license fee in an amount not to exceed $50 per year. Sets forth the information that the licensee is required to provide to the municipality. Effective immediately.

Be it enacted by the People of the State of Illinois, represented in the General Assembly:

Section 5. The Illinois Municipal Code is amended by adding Section 11-30-15 as follows:

(65 ILCS 5/11-30-15 new)

Sec. 11-30-15. Residential rental property managers; licensing.

(a) In order to promote the health, safety, and welfare of the public and of the occupants of residential rental property, the corporate authorities of any municipality may license residential rental property managers in a manner consistent with this Section.

(b) A licensing ordinance enacted under this Section shall apply to any person, firm, or corporation that has management or control of a building, or portion of a building, other than a hotel or motel, within the municipality if the building contains 3 or more apartments that are not occupied by an owner of the building. This Section applies to such a person, firm, or corporation regardless of whether the person, firm, or corporation has management or control of the property as a legal or equitable owner, as a managing agent, or otherwise.

(c) The municipality may require the licensee to pay a license fee in an amount not to exceed $50 per year and shall require only the following information from the licensee:

(1) the name, address, and phone number of the licensee;

(2) the name, address, and phone number of any person who will handle property maintenance complaints on behalf of the licensee within the municipality and who is authorized to accept service of municipal code violation complaints on behalf of the licensee;

(3) a list of all properties managed by the licensee within the municipality; and

(4) a certification by the licensee that the licensee is aware of the municipality's code requirements applicable to any property managed by the licensee.

(d) For purposes of this Section, "apartment" means a self-contained residential living unit, with private bath and cooking facilities, that is intended for occupation as a permanent place of abode by someone other than the owner of the property. "Apartment" does not include any unit that is intended for occupation on a transient basis for a short period of occupancy.

Section 99. Effective date. This Act takes effect upon becoming law.
