720 ILCS 5/21-4   from Ch. 38, par. 21-4

    Amends the Criminal Code of 1961. Makes a technical change in a Section concerning criminal damage to government supported property.

A BILL FOR

1     AN ACT concerning criminal law.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Criminal Code of 1961 is amended by changing
5 Section 21-4 as follows:
 
6     (720 ILCS 5/21-4)  (from Ch. 38, par. 21-4)
7     Sec. 21-4. Criminal Damage to Government Supported
8 Property.
9     (1) Any of the the following acts is a Class 4 felony when
10 the damage to property is $500 or less, and any such act is a
11 Class 3 felony when the damage to property exceeds $500 but
12 does not exceed $10,000; a Class 2 felony when the damage to
13 property exceeds $10,000 but does not exceed $100,000 and a
14 Class 1 felony when the damage to property exceeds $100,000:
15         (a) Knowingly damages any property supported in whole
16     or in part with State funds, funds of a unit of local
17     government or school district, or Federal funds
18     administered or granted through State agencies without the
19     consent of the State; or
20         (b) Knowingly, by means of fire or explosive damages
21     property supported in whole or in part with State funds,
22     funds of a unit of local government or school district, or
23     Federal funds administered or granted through State

1     agencies; or
2         (c) Knowingly starts a fire on property supported in
3     whole or in part with State funds, funds of a unit of local
4     government or school district, or Federal funds
5     administered or granted through State agencies without the
6     consent of the State; or
7         (d) Knowingly deposits on land or in a building
8     supported in whole or in part with State funds, funds of a
9     unit of local government or school district, or Federal
10     funds administered or granted through State agencies
11     without the consent of the State, any stink bomb or any
12     offensive smelling compound and thereby intends to
13     interfere with the use by another of the land or building.
14     (2) When the damage to property exceeds $10,000, the court
15 shall impose upon the offender a fine equal to the value of the
16 damages to the property.
