SYNOPSIS AS INTRODUCED:
 
625 ILCS 5/1-171.3
625 ILCS 5/3-304   from Ch. 95 1/2, par. 3-304

    Amends the Illinois Vehicle Code. Provides that a person is not a repairer under the Code if he or she is solely engaged in the business of repairing dents or other damage to a vehicle surface, the dents or other damaged areas measure less than 2 inches across, and the person does not otherwise restore, mend, straighten, replace, or alter essential parts. Provides that, if an applicant for a certificate of title for a rebuilt vehicle states either that he or she personally rebuilt the vehicle or that he or she personally supervised its rebuilding, the applicant must affirm in writing that he or she is a licensed rebuilder. Provides that, if the applicant states that he or she has contracted for rebuilding with a licensed rebuilder, the applicant shall submit a statement from the rebuilder, in the form designated by the Secretary of State, stating that all of the supporting documentation and the contents of the application are, to the best of the rebuilder's knowledge and belief, complete, true, and correct.

1     AN ACT concerning transportation.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Illinois Vehicle Code is amended by changing
5 Sections 1-171.3 and 3-304 as follows:
 
6     (625 ILCS 5/1-171.3)
7     Sec. 1-171.3. Repairer. A person who is in the business of
8 returning a vehicle other than a vehicle for which a salvage
9 certificate has been issued back to its original or operating
10 condition by restoring, mending, straightening, replacing,
11 altering, or painting its essential parts. The term "repairer"
12 does not include a person who is solely engaged in the business
13 of repairing dents or other damage to a vehicle surface, if the
14 dents or other damaged areas measure less than 2 inches across
15 at the widest point and the person does not otherwise restore,
16 mend, straighten, replace, or alter essential parts in the
17 course of those repairs.

20     Sec. 3-304. Application for title - affirmation.
21     (a) The applicant applying for a certificate of title for a
22 rebuilt vehicle shall sign a written affirmation which states

1 the following:
2         1. He or she:
3             (A) is a licensed rebuilder and personally rebuilt
4         the vehicle; ,
5             (B) is a licensed rebuilder and personally
6     supervised its rebuilding; or
7             (C) contracted for rebuilding with a licensed
8     rebuilder;
9         2. He or she personally inspected the completed
10     vehicle, and it complies with all safety requirements set
11     forth in this Code and any regulations promulgated
12     thereunder by the Secretary of State;
13         3. The identification numbers of the rebuilt vehicle
14     and its parts have not, to the knowledge of the applicant,
15     been removed, destroyed, falsified, altered or defaced;
16         4. The salvage certificate or out-of-state title
17     certificate attached to the application has not, to the
18     knowledge of the applicant, been forged, falsified,
19     altered or counterfeited; and
20         5. All information contained on the application and its
21     attachments is true and correct to the knowledge of the
22     applicant.
23     (b) If the applicant states that he or she has contracted
24 for rebuilding with a licensed rebuilder, the applicant shall
25 submit a statement from the rebuilder, in the form designated
26 by the Secretary, stating that all of the supporting

1 documentation and the contents of the application are, to the
2 best of the rebuilder's knowledge and belief, complete, true,
3 and correct.
