735 ILCS 5/12-103   from Ch. 110, par. 12-103

    Amends the Code of Civil Procedure. Makes a technical change in a Section concerning a judgment entered against a person in his or her representative capacity.

1     AN ACT concerning civil law.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Code of Civil Procedure is amended by
5 changing Section 12-103 as follows:
 
6     (735 ILCS 5/12-103)  (from Ch. 110, par. 12-103)
7     Sec. 12-103. Representative capacity. A judgment entered
8 against a person not as a result of a contract made by him or
9 her or a tort committed by him or her but solely because he or
10 she is the the holder of title to property as receiver, trustee
11 of a specifically identified trust, representative as defined
12 in Section 1-2.11 of the Probate Act of 1975, or in any other
13 fiduciary capacity, shall be enforced only against property
14 held in the particular representative capacity, but no judgment
15 shall be enforced against nor shall the judgment constitute a
16 lien upon, other property owned by such person, whether
17 individually or in some other designated identifiable
18 representative capacity.
