SYNOPSIS AS INTRODUCED:
 
625 ILCS 5/11-1430 new

    Amends the Illinois Vehicle Code. Provides that a person may not operate a pickup truck on a public highway while the open cargo area of the pickup truck is occupied by any person. Provides that the prohibition does not apply to recreational vehicles or truck campers. Provides that the prohibition does not apply to a pickup truck that is being used in production agriculture or in an emergency situation or to a pickup truck that is being driven in a parade or to or from a parade in which the pickup truck has been or is to be driven. Provides that a violation is a Class C misdemeanor.

1     AN ACT concerning transportation.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Illinois Vehicle Code is amended by adding
5 Section 11-1430 as follows:
 
6     (625 ILCS 5/11-1430 new)
7     Sec. 11-1430. No passengers in the open cargo area of a
8 pickup truck.
9     (a) As used in this Section, "pickup truck" means a 2-axle
10 motor vehicle manufactured or materially altered to provide an
11 open cargo area. "Pickup truck" includes a motor vehicle with
12 the open cargo area covered by a tarp or a removable top.
13     (b) A person may not operate a pickup truck on a public
14 highway while the open cargo area of the pickup truck is
15 occupied by any person.
16     (c) A violation of this Section is a Class C misdemeanor.
17     (d) This Section does not apply to the following:
18         (1) recreational vehicles or truck campers;
19         (2) a pickup truck being used in production
20     agriculture, as defined in Section 3-35 of the Use Tax Act;
21         (3) a pickup truck being used in an emergency
22     situation; or
23         (4) a pickup truck being driven (i) in a parade or (ii)
