1     AN ACT concerning criminal law.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Air Rifle Act is amended by changing
5 Sections 2, 3, and 4 as follows:
 
6     (720 ILCS 535/2)  (from Ch. 38, par. 82-2)
7     Sec. 2. It is unlawful for any dealer to sell, lend, rent,
8 give or otherwise transfer an air rifle to any person under the
9 age of 18 13 years where the dealer knows or has cause to
10 believe the person to be under 18 13 years of age or where such
11 dealer has failed to make reasonable inquiry relative to the
12 age of such person and such person is under 18 13 years of age.
13     It is unlawful for any person to sell, give, lend or
14 otherwise transfer any air rifle to any person under 18 13
15 years of age except where the relationship of parent and child,
16 guardian and ward or adult instructor and pupil, exists between
17 such person and the person under 18 13 years of age, or where
18 such person stands in loco parentis to the person under 18 13
19 years of age.

22     Sec. 3. It is unlawful for any person under 18 13 years of

1 age to carry any air rifle on the public streets, roads,
2 highways or public lands within this State, unless such person
3 under 13 years of age carries such rifle unloaded.
4     It is unlawful for any person to discharge any air rifle
5 from or across any street, sidewalk, road, highway or public
6 land or any public place except on a safely constructed target
7 range.

10     Sec. 4. Notwithstanding any provision of this Act, it is
11 lawful for any person under 18 13 years of age to have in his
12 possession any air rifle if it is:
13     (1) Kept within his house of residence or other private
14 enclosure;
15     (2) Used by the person under 18 13 years of age and he is a
16 duly enrolled member of any club, team or society organized for
17 educational purposes and maintaining as part of its facilities
18 or having written permission to use an indoor or outdoor rifle
19 range under the supervision guidance and instruction of a
20 responsible adult and then only if said air rifle is actually
21 being used in connection with the activities of said club team
22 or society under the supervision of a responsible adult; or
23     (3) Used in or on any private grounds or residence under
24 circumstances when such air rifle is fired, discharged or
25 operated in such a manner as not to endanger persons or

1 property and then only if it is used in such manner as to
2 prevent the projectile from passing over any grounds or space
3 outside the limits of such grounds or residence.
