SYNOPSIS AS INTRODUCED:
 
New Act

    Creates the Artificial Trans Fat Restriction Act. Provides that no foods containing artificial trans fat shall be stored, distributed, held for service, or used in the preparation of any menu item or served in any food service establishment or by any mobile food unit commissary except food that is being served directly to patrons in a manufacturer's original sealed package. Provides that a food shall be deemed to contain artificial trans fat if the food is labeled as, lists as an ingredient, or has vegetable shortening, margarine, or any kind of partially hydrogenated vegetable oil. Provides that a food whose nutrition facts label or other documentation from the manufacturer lists the trans fat content of the food as less than 0.5 grams per serving, shall not be deemed to contain artificial trans fat. Effective January 1, 2008.

1     AN ACT concerning public health.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 1. Short title. This Act may be cited as the
5 Artificial Trans Fat Restriction Act.
 
6     Section 5. Artificial trans fat restricted. No foods
7 containing artificial trans fat shall be stored, distributed,
8 held for service, or used in the preparation of any menu item
9 or served in any food service establishment or by any mobile
10 food unit commissary except food that is being served directly
11 to patrons in a manufacturer's original sealed package. For
12 purposes of this Section, a food shall be deemed to contain
13 artificial trans fat if the food is labeled as, lists as an
14 ingredient, or has vegetable shortening, margarine, or any kind
15 of partially hydrogenated vegetable oil. However, a food whose
16 nutrition facts label or other documentation from the
17 manufacturer lists the trans fat content of the food as less
18 than 0.5 grams per serving, shall not be deemed to contain
19 artificial trans fat.
 
20     Section 99. Effective date. This Act takes effect January
21 1, 2008.
