SYNOPSIS AS INTRODUCED:
 
ILCON Art. VIII, Sec. 2

    Proposes to amend the Finance Article of the Illinois Constitution. Provides for biennial budgets and appropriations. Defines a "fiscal biennium" as July 1 of each odd-numbered year though June 30 of the ensuing odd-numbered year. Effective upon being declared adopted.

CONSTITUTIONAL AMENDMENT

 
3     RESOLVED, BY THE SENATE OF THE NINETY-FOURTH GENERAL
4 ASSEMBLY OF THE STATE OF ILLINOIS, THE HOUSE OF REPRESENTATIVES
5 CONCURRING HEREIN, that there shall be submitted to the
6 electors of the State for adoption or rejection at the general
7 election next occurring at least 6 months after the adoption of
8 this resolution a proposition to amend Section 2 of Article
9 VIII of the Illinois Constitution as follows:

13 SECTION 2. STATE FINANCE
14     (a) The Governor shall prepare and submit to the General
15 Assembly, at a time prescribed by law, a State budget for the
16 ensuing fiscal biennium year. The budget shall set forth the
17 estimated balance of funds available for appropriation at the
18 beginning of the fiscal biennium year, the estimated receipts,
19 and a plan for expenditures and obligations during the fiscal
20 biennium year of every department, authority, public
21 corporation and quasi-public corporation of the State, every
22 State college and university, and every other public agency
23 created by the State, but not of units of local government or
24 school districts. The budget shall also set forth the
25 indebtedness and contingent liabilities of the State and such
26 other information as may be required by law. Proposed
27 expenditures shall not exceed funds estimated to be available
28 for the fiscal biennium year as shown in the budget.
29     (b) The General Assembly by law shall make appropriations
30 for all expenditures of public funds by the State.
31 Appropriations for a fiscal biennium year shall not exceed
32 funds estimated by the General Assembly to be available during
33 that biennium year.

1     (c) The fiscal biennium shall commence on July 1 of each
2 odd-numbered year and end on June 30 of the ensuing
3 odd-numbered year.

SCHEDULE
6     This Constitutional Amendment takes effect upon being
7 declared adopted in accordance with Section 7 of the Illinois
8 Constitutional Amendment Act.
