SYNOPSIS AS INTRODUCED:
 
430 ILCS 65/13.2   from Ch. 38, par. 83-13.2

    Amends the Firearm Owners Identification Card Act. Provides for an extension period during which a Firearm Owner's Identification Card remains valid if the owner has forwarded an application of renewal to the Department of State Police. Provides that the extension period does not apply to persons otherwise prohibited from renewing a Firearm Owner's Identification Card. Effective immediately.

1     AN ACT concerning public safety.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Firearm Owners Identification Card Act is
5 amended by changing Section 13.2 as follows:
 
6     (430 ILCS 65/13.2)  (from Ch. 38, par. 83-13.2)
7     Sec. 13.2. Renewal.
8     (a) The Department of State Police shall, 60 days prior to
9 the expiration of a Firearm Owner's Identification Card,
10 forward by first class mail to each person whose card is to
11 expire a notification of the expiration of the card and an
12 application which may be used to apply for renewal of the card.
13 It is the obligation of the holder of a Firearm Owner's
14 Identification Card to notify the Department of State Police of
15 any address change since the issuance of the Firearm Owner's
16 Identification Card.
17     (b) If, prior to the expiration of a Firearm Owner's
18 Identification Card, the holder of such a card forwards to the
19 Department of State Police by first class mail a completed
20 application for renewal of such a card accompanied by the
21 required fee, notwithstanding its printed expiration date,
22 that Firearm Owner's Identification Card shall remain valid
23 until Department of State Police either renews or declines to
24 renew that Firearm Owner's Identification Card. The United
25 States Postal Service post marked date shall be prima facie
26 evidence of the date upon which the renewal application was
27 forwarded to the Department of State Police. Evidence of such
28 timely mailing shall serve as an affirmative defense to any
29 criminal offense or other statutory violation to the extent
30 that the same is based on the failure to possess a valid
31 Firearms Owner's Identification Card. Nothing in this
32 subsection (b) shall be construed to allow the extension or

1 renewal of a Firearms Owner's Identification Card by a person
2 otherwise prohibited therefrom.
