    Amends the Election Code. Provides for the registration and voting of lawful permanent residents otherwise qualified to vote except for U.S. citizenship. Authorizes voting by lawful permanent residents only for school board candidates and for or against public questions of school districts.

1     AN ACT concerning elections.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Election Code is amended by adding the
5 heading of Article 19B and Sections 19B-5, 19B-10, 19B-15,
6 19B-20, 19B-25, and 19B-30 as follows:

ARTICLE 19B. LAWFUL PERMANENT RESIDENTS

10     Sec. 19B-5. Definitions. As used in this Article:
11     "Lawful permanent resident" means a lawful permanent
12 resident as defined by the federal Immigration and Nationality
13 Act and recognized by the United States Attorney General.
14     "Public question" means a public question submitted to
15 voters of a school district.
16     "State Board" means the State Board of Elections.

18     Sec. 19B-10. Registration of lawful permanent residents.
19     (a) A lawful permanent resident of a school district in
20 Illinois who, except for his or her lack of United States
21 citizenship, is qualified to register to vote under Article 4,
22 5, or 6 may register as a lawful permanent resident voter under
23 subsection (b).
24     (b) Using forms and procedures prescribed by the State
25 Board, an election authority shall accept the registration of a
26 lawful permanent resident of the election jurisdiction who
27 meets all requirements of this Code for registration except
28 United States citizenship. Registration under this subsection
29 shall be accepted during the same registration periods
30 established under Articles 4, 5, and 6, but not including the

1 grace registration periods established in Sections 4-50, 5-50,
2 and 6-100. Registration under this subsection shall be accepted
3 by the same persons authorized to accept registration under
4 Article 4, 5, or 6. Registration under this subsection must be
5 in person and, in addition to any other evidence of voter
6 qualification, the applicant for registration must present:
7         (1) Documentation as a lawful permanent resident
8     pursuant to the federal Immigration and Nationality Act,
9     including immigrant visa number.
10         (2) A valid identification card containing a
11     relatively current photograph of the applicant or one of
12     the following, dated no more than 30 days before the date
13     of application for registration, that states the
14     applicant's name and residential address: (i) utility
15     bill, (ii) bank statement, (iii) paycheck, or (iv)
16     government check, or other government document.
17     (c) Registration record cards of lawful permanent
18 residents shall be maintained separately from other voter
19 registration record cards.

21     Sec. 19B-15. Separate ballots. For each primary or election
22 at which any candidate for a school board office shall be
23 nominated or elected or at which a public question shall be
24 submitted to the voters of one or more school districts, each
25 election authority shall prepare and print a separate ballot
26 that contains only the names of those school board candidates
27 and those public questions. The ballot shall be referred to as
28 the lawful permanent resident's ballot and shall be prepared
29 and printed at the same time as specified in this Code for
30 other ballots for that primary or election. The lawful
31 permanent resident's ballot shall be in a form prescribed by
32 the State Board in compliance with the requirements of this
33 Code for style and appearance of ballots, including
34 accommodation of write-in candidates.

2     Sec. 19B-20. Voting.
3     (a) Each lawful permanent resident registered pursuant to
4 Section 19B-10 may vote for the candidates and for or against
5 the public questions on the appropriate lawful permanent
6 resident's ballot for the school district in which he or she
7 resides as provided in this Section.
8     (b) Each election authority shall conduct lawful permanent
9 resident voting at the times and places and in the manner
10 prescribed in Article 19 for absentee voting. Lawful permanent
11 resident voting shall not be conducted as part of early voting
12 under Article 19A. Lawful permanent residents may not vote in
13 precincts on election day, and no person seeking to vote as a
14 lawful permanent resident shall be given a provisional ballot
15 under Article 18A.
16     (c) Lawful permanent resident's ballots cast under this
17 Section shall be handled and counted separately from absentee
18 ballots in accordance with procedures prescribed by the State
19 Board. Lawful permanent resident's ballots shall be delivered
20 to the election authority's central ballot counting location
21 before the polls close on election day; no lawful permanent
22 resident ballots shall be delivered to or counted at precinct
23 polling places.

25     Sec. 19B-25. Outreach. In addition to any other
26 requirements of public notice, each school district must
27 implement a program developed in coordination with the State
28 Board and the appropriate local election authority to inform
29 lawful permanent residents of their rights to register and vote
30 under this Article and the procedures for doing so.

32     Sec. 19B-30. Rules. The State Board shall adopt rules for
33 the implementation of this Article.
