SYNOPSIS AS INTRODUCED:
 
305 ILCS 5/5-5.01a

    Amends the Illinois Public Aid Code. In provisions concerning the supportive living facilities demonstration project under the Medicaid program, provides that the Long Term Care Subcommittee of the Medicaid Advisory Committee shall provide advice to the Director of Public Aid regarding all aspects of the supportive living facility demonstration project. Provides that on and after January 1, 2006, all administrative rules and changes to administrative rules proposed in connection with the supportive living facility demonstration project must be provided to the Long Term Care Subcommittee for review and comment before notice of the proposed rules or changes is given to the public. Provides that after the Long Term Care Subcommittee has an opportunity to review and comment on the proposed rules or changes at its next quarterly meeting, the Department of Public Aid may proceed with adopting the rules or changes. Effective immediately.

1     AN ACT concerning public aid.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Illinois Public Aid Code is amended by
5 changing Section 5-5.01a as follows:
 
6     (305 ILCS 5/5-5.01a)
7     Sec. 5-5.01a. Supportive living facilities demonstration
8 project. For the purpose of studying alternative settings for
9 long term care, the Department may establish and provide
10 oversight for a demonstration project to determine the
11 viability of supportive living facilities that seek to promote
12 resident independence, dignity, respect, and well-being in the
13 most cost-effective manner.
14     A supportive living facility is either a free-standing
15 facility or a distinct physical and operational entity within a
16 nursing facility. A supportive living facility integrates
17 housing with health, personal care, and supportive services and
18 is a designated setting that offers residents their own
19 separate, private, and distinct living units.
20     Demonstration sites shall be selected by the Department
21 based upon criteria that may include the need for services in a
22 geographic area, the availability of funding, and the site's
23 ability to meet the standards.
24     The Department may adopt rules to implement this Section.
25 Rules that establish or modify the services, standards, and
26 conditions for participation in the demonstration project
27 shall be adopted by the Department in consultation with the
28 Department on Aging, the Department of Rehabilitation
29 Services, and the Department of Mental Health and Developmental
30 Disabilities (or their successor agencies).
31     The Long Term Care Subcommittee of the Medicaid Advisory
32 Committee shall provide advice to the Director of Public Aid

1 regarding all aspects of the supportive living facility
2 demonstration project. On and after January 1, 2006, all
3 administrative rules and changes to administrative rules
4 proposed in connection with the supportive living facility
5 demonstration project must be provided to the Long Term Care
6 Subcommittee for review and comment before notice of the
7 proposed rules or changes is given to the public. After the
8 Long Term Care Subcommittee has an opportunity to review and
9 comment on the proposed rules or changes at its next quarterly
10 meeting, the Department of Public Aid may proceed with adopting
11 the rules or changes.
12     Facilities or distinct parts of facilities which are
13 selected as supportive living facilities and are in good
14 standing with the Department's rules are exempt from the
15 provisions of the Nursing Home Care Act and the Illinois Health
16 Facilities Planning Act.

18     Section 99. Effective date. This Act takes effect upon
19 becoming law.
