SYNOPSIS AS INTRODUCED:
 
225 ILCS 10/5.7 new

    Amends the Child Care Act of 1969. Provides that upon the permanent or temporary closure of any licensed facility operating as a child care institution, maternity center, day care center, part day child care facility, or day care agency, the facility must provide written notice of the closure to the parents or guardians of those children to whom the facility provides services. Provides that this notice must be provided at least 30 days prior to the closing of the facility. Provides for the imposition of fines for failure to provide the notice. Prohibits a license applicant from obtaining a renewal of an existing license or a new license until the fines have been paid. Effective immediately.

1     AN ACT concerning regulation.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Child Care Act of 1969 is amended by adding
5 Section 5.7 as follows:
 
6     (225 ILCS 10/5.7 new)
7     Sec. 5.7. Notice of facility closure. Upon the permanent or
8 temporary closure of any licensed facility operating as a child
9 care institution, maternity center, day care center, part day
10 child care facility, or day care agency, the facility must
11 provide written notice of the closure to the parents or
12 guardians of those children to whom the facility provides
13 services. This notice must be provided at least 30 days prior
14 to the closing of the facility.
15     A facility that fails to provide the notice required by
16 this Section is subject to a $500 fine. Failure to pay the $500
17 fine within 12 months after it is imposed shall result in an
18 additional fine of $750. In the case of a temporary closure,
19 the license applicant must pay all of the fines required by
20 this Section before the license is renewed or a new license is
21 issued to that license applicant.
22     In this Section, "temporary closure" means any complete
23 closure of a facility that is not permanent, but which shall
24 last longer than 30 days.
 
25     Section 99. Effective date. This Act takes effect upon
26 becoming law.
