SYNOPSIS AS INTRODUCED:
 
30 ILCS 105/14   from Ch. 127, par. 150

    Amends the State Finance Act. Provides that for State fiscal year 2007 and thereafter, the item "personal services", when used in an appropriation Act, includes only personal services rendered by a resident of Illinois. This requirement may be waived, in writing, by the head of the employing agency only if out-of-state residence is required to perform the personal services or in the case of extreme undue hardship. The Comptroller must adopt rules to implement and administer this residency requirement.

1     AN ACT concerning State government.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The State Finance Act is amended by changing
5 Section 14 as follows:
 
6     (30 ILCS 105/14)  (from Ch. 127, par. 150)
7     Sec. 14. The item "personal services", when used in an
8 appropriation Act, means the reward or recompense made for
9 personal services rendered for the State by an officer or
10 employee of the State or of an instrumentality thereof, or for
11 the purpose of Section 14a of this Act, or any amount required
12 or authorized to be deducted from the salary of any such person
13 under the provisions of Section 30c of this Act, or any
14 retirement or tax law, or both, or deductions from the salary
15 of any such person under the Social Security Enabling Act or
16 deductions from the salary of such person pursuant to the
17 Voluntary Payroll Deductions Act of 1983.
18     If no home is furnished to a person who is a full-time
19 chaplain employed by the State or a former full-time chaplain
20 retired from State employment, 20% of the salary or pension
21 paid to that person for his personal services to the State as
22 chaplain are considered to be a rental allowance paid to him to
23 rent or otherwise provide a home. This amendatory Act of 1973
24 applies to State salary amounts received after December 31,
25 1973.
26     When any appropriation payable from trust funds or federal
27 funds includes an item for personal services but does not
28 include a separate item for State contribution for employee
29 group insurance, the State contribution for employee group
30 insurance in relation to employees paid under that personal
31 services line item shall also be payable under that personal
32 services line item.

1     When any appropriation payable from trust funds or federal
2 funds includes an item for personal services but does not
3 include a separate item for employee retirement contributions
4 paid by the employer, the State contribution for employee
5 retirement contributions paid by the employer in relation to
6 employees paid under that personal services line item shall
7 also be payable under that personal services line item.
8     The item "personal services", when used in an appropriation
9 Act, shall also mean and include a payment to a State
10 retirement system by a State agency to discharge a debt arising
11 from the over-refund to an employee of retirement
12 contributions. The payment to a State retirement system
13 authorized by this paragraph shall not be construed to release
14 the employee from his or her obligation to return to the State
15 the amount of the over-refund.
16     The item "personal services", when used in an appropriation
17 Act, also includes a payment to reimburse the Department of
18 Central Management Services for temporary total disability
19 benefit payments in accordance with subdivision (9) of Section
20 405-105 of the Department of Central Management Services Law
21 (20 ILCS 405/405-105).
22     Beginning July 1, 1993, the item "personal services" and
23 related line items, when used in an appropriation Act or this
24 Act, shall also mean and include back wage claims of State
25 officers and employees to the extent those claims have not been
26 satisfied from the back wage appropriation to the Department of
27 Central Management Services in the preceding fiscal year, as
28 provided in Section 14b of this Act and subdivision (13) of
29 Section 405-105 of the Department of Central Management
30 Services Law (20 ILCS 405/405-105).
31     The item "personal services", when used with respect to
32 State police officers in an appropriation Act, also includes a
33 payment for the burial expenses of a State police officer
34 killed in the line of duty, made in accordance with Section
35 12.2 of the State Police Act and any rules adopted under that
36 Section.

1     For State fiscal year 2005, the item "personal services",
2 when used in an appropriation Act, also includes payments for
3 employee retirement contributions paid by the employer.
4     For State fiscal year 2007 and thereafter, the item
5 "personal services", and any related or similar item, when used
6 in an appropriation Act, includes only personal services
7 rendered by a resident of Illinois. This requirement may be
8 waived, in writing, by the head of the employing agency only if
9 out-of-state residence is required to perform the personal
10 services or in the case of extreme undue hardship. The
11 Comptroller must adopt rules to implement and administer this
12 residency requirement. This residency requirement shall be
13 liberally construed to ensure that only persons who are
14 Illinois residents are employed for compensation by the State
15 unless a waiver has been granted.
