SYNOPSIS AS INTRODUCED:
 
ILCON Art. IV, Sec. 8.5 new

    Proposes to amend the Legislature Article of the Illinois Constitution. Provides that a bill that contains one or more provisions that would result in the increase of revenue to the State may become law only if each of those provisions is explicitly limited in effect to no more than 5 years after the effective date of the bill. Provides that a sunset date on a provision that increases revenue to the State may be extended by the General Assembly by law for up to an additional 5 years in each of up to 3 separate bills and that if the General Assembly extends the sunset date 3 additional times, the sunset date may be removed. Effective on being declared adopted.

CONSTITUTIONAL AMENDMENT

 
3     RESOLVED, BY THE HOUSE OF REPRESENTATIVES OF THE
4 NINETY-FOURTH GENERAL ASSEMBLY OF THE STATE OF ILLINOIS, THE
5 SENATE CONCURRING HEREIN, that there shall be submitted to the
6 electors of the State for adoption or rejection at the general
7 election next occurring at least 6 months after the adoption of
8 this resolution a proposition to add Section 8.5 to Article IV
9 of the Illinois Constitution as follows:

THE LEGISLATURE

12     (ILCON Art. IV, Sec. 8.5 new)
13 SECTION 8.5. REVENUE BILLS; SUNSET
14     (a) A bill that contains one or more provisions that would
15 result in the increase of revenue to the State may become law
16 only if each of those provisions is explicitly limited in
17 effect to no more than 5 years after the effective date of the
18 bill.
19     (b) A sunset date established under subsection (a) may be
20 extended by the General Assembly by law for up to an additional
21 5 years in each of up to 3 separate bills. If the General
22 Assembly extends the sunset date of a provision 3 additional
23 times, the General Assembly by law may thereafter remove the
24 sunset date as to that provision.
25     (c) A bill that fails to comply with this Section is void.

SCHEDULE
27     This Constitutional Amendment takes effect upon being
28 declared adopted in accordance with Section 7 of the Illinois
29 Constitutional Amendment Act.
