SYNOPSIS AS INTRODUCED:

    Amends the Podiatric Medical Practice Act of 1987. Removes the exception of the administration of general anesthetics and the amputation of the human foot from the definition of "podiatric medicine" or "podiatry". Provides that of the moneys deposited into the Illinois State Podiatric Disciplinary Fund, during each 2-year renewal period, $200,000 (rather than 15%) of the money received from the payment of renewal fees shall be used for certain scholarships, residency programs, and other expenses. Effective immediately.

1     AN ACT concerning regulation.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Podiatric Medical Practice Act of 1987 is
5 amended by changing Sections 5 and 19 as follows:
 
6     (225 ILCS 100/5)  (from Ch. 111, par. 4805)
7     (Section scheduled to be repealed on January 1, 2008)
8     Sec. 5. Definitions. As used in this Act:
9     (A) "Department" means the Department of Professional
10 Regulation.
11     (B) "Director" means the Director of Professional
12 Regulation.
13     (C) "Board" means the Podiatric Medical Licensing Board
14 appointed by the Director.
15     (D) "Podiatric medicine" or"podiatry" means the diagnosis,
16 medical, physical, or surgical treatment of the ailments of the
17 human foot with the exception of administration of general
18 anesthetics and the amputation of the human foot. For the
19 purposes of this Act, the terms podiatric medicine, podiatry
20 and chiropody have the same definition.
21     (E) "Human foot" means the ankle and soft tissue which
22 insert into the foot as well as the foot.
23     (F) "Podiatric physician" means a physician licensed to
24 practice podiatric medicine.
25     (G) "Postgraduate training" means a minimum one year
26 postdoctoral structured and supervised educational experience
27 approved by the Council on Podiatric Medical Education of the
28 American Podiatric Medical Association which includes
29 residencies and preceptorships.

1     (Section scheduled to be repealed on January 1, 2008)
2     Sec. 19. Disciplinary Fund. All fees and fines received by
3 the Department under this Act shall be deposited in the
4 Illinois State Podiatric Disciplinary Fund, a special fund
5 created hereunder in the State Treasury. Of the moneys
6 deposited into the Illinois State Podiatric Disciplinary Fund,
7 during each 2-year renewal period, $200,000 15% of the money
8 received from the payment of renewal fees shall be used for
9 podiatric scholarships and residency programs under the
10 Podiatric Scholarship and Residency Act and the remainder shall
11 be appropriated to the Department for expenses of the
12 Department and of the Podiatric Medical Licensing Board and for
13 podiatric scholarships and residency programs under the
14 Podiatric Scholarship and Residency Act.
15     Moneys in the Illinois State Podiatric Disciplinary Fund
16 may be invested and reinvested in investments authorized for
17 the investment of funds of the State Employees' Retirement
18 System of Illinois.
19     All earnings received from such investments shall be
20 deposited in the Illinois State Podiatric Disciplinary Fund and
21 may be used for the same purposes as fees deposited in such
22 fund.
23     Moneys in the Fund may be transferred to the Professions
24 Indirect Cost Fund as authorized under Section 2105-300 of the
25 Department of Professional Regulation Law (20 ILCS
26 2105/2105-300).
27     Upon the completion of any audit of the Department as
28 prescribed by the Illinois State Auditing Act which includes an
29 audit of the Illinois State Podiatric Disciplinary Fund, the
30 Department shall make the audit open to inspection by any
31 interested person.

34     Section 99. Effective date. This Act takes effect upon
35 becoming law.
