SYNOPSIS AS INTRODUCED:
 
305 ILCS 5/5-5e new

    Amends the Illinois Public Aid Code. Provides that under the Medicaid program, the Department of Public Aid shall apply for any necessary waivers pursuant to the Social Security Act to develop supportive living facilities for persons with mental illness. Provides that any such waiver application shall be developed in cooperation with the Department of Human Services, the Department of Public Health, the Department on Aging, the Guardianship and Advocacy Commission, other State agencies as appropriate, operators of nursing facilities, and others. Effective immediately.

1     AN ACT concerning public aid.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Illinois Public Aid Code is amended by
5 adding Section 5-5e as follows:
 
6     (305 ILCS 5/5-5e new)
7     Sec. 5-5e. Persons with mental illness; supportive living
8 facilities. The Department of Public Aid shall apply for any
9 necessary waivers pursuant to Section 1915(c) of the Social
10 Security Act to develop supportive living facilities for
11 persons with mental illness. Any such waiver application shall
12 be developed in cooperation with the Department of Human
13 Services, the Department of Public Health, the Department on
14 Aging, the Guardianship and Advocacy Commission, other State
15 agencies as appropriate, operators of facilities licensed
16 under the Nursing Home Care Act, operators of institutions for
17 mental diseases, community mental health agency
18 representatives, and supportive housing providers, as defined
19 by law or in rules adopted by the Department of Public Aid.
 
20     Section 99. Effective date. This Act takes effect upon
21 becoming law.
