1     AN ACT concerning State government.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The State Fire Marshal Act is amended by
5 changing Sections 1 and 2 as follows:
 
6     (20 ILCS 2905/1)  (from Ch. 127 1/2, par. 1)
7     Sec. 1. There is hereby created the Office of the State
8 Fire Marshal, hereinafter referred to as the Office.
9     The Office shall be under an executive director who shall
10 be appointed by the Governor with the advice and consent of the
11 Senate.
12     The executive director of the Office shall be known as the
13 State Fire Marshal and shall receive an annual salary as set by
14 the Governor from time to time or as set by the Compensation
15 Review Board, whichever is greater. If set by the Governor, the
16 annual salary may not exceed 85% of the annual salary of the
17 Governor.
18     The Office of the State Fire Marshal shall have a division
19 that Division of Fire Prevention which shall assume the duties
20 of the Division of Fire Prevention, Department of Law
21 Enforcement, and a division that Division of Personnel
22 Standards and Education which shall assume the duties of
23 Illinois Fire Protection Personnel Standards and Education
24 Commission. Each division Division shall be headed by a
25 division manager who deputy State Fire Marshal. The deputy
26 State Fire Marshals shall be employed by the Fire Marshal,
27 subject to the Personnel Code, and shall be responsible to the
28 Fire Marshal.

31     Sec. 2. The Office shall have the following powers and

1 duties:
2     1. To exercise the rights, powers and duties which have
3 been vested by law in the Department of State Police as the
4 successor of the Department of Public Safety, State Fire
5 Marshal, deputy State Fire Marshal, inspectors, officers and
6 employees of the State Fire Marshal, including arson
7 investigation.
8     2. To keep a record, as may be required by law, of all
9 fires occurring in the State, together with all facts,
10 statistics and circumstances, including the origin of fires.
11     3. To exercise the rights, powers and duties which have
12 been vested in the Department of State Police by the "Boiler
13 and Pressure Vessel Safety Act", approved August 7, 1951, as
14 amended.
15     4. To administer the Illinois Fire Protection Training Act.
16     5. To aid in the establishment and maintenance of the
17 training facilities and programs of the Illinois Fire Service
18 Institute.
19     6. To disburse Federal grants for fire protection purposes
20 to units of local government.
21     7. To pay to or in behalf of the City of Chicago for the
22 maintenance, expenses, facilities and structures directly
23 incident to the Chicago Fire Department training program. Such
24 payments may be made either as reimbursements for expenditures
25 previously made by the City, or as payments at the time the
26 City has incurred an obligation which is then due and payable
27 for such expenditures. Payments for the Chicago Fire Department
28 training program shall be made only for those expenditures
29 which are not claimable by the City under "An Act relating to
30 fire protection training", certified November 9, 1971, as
31 amended.
32     8. To administer General Revenue Fund grants to areas not
33 located in a fire protection district or in a municipality
34 which provides fire protection services, to defray the
35 organizational expenses of forming a fire protection district.
36     9. In cooperation with the Illinois Environmental

1 Protection Agency, to administer the Illinois Leaking
2 Underground Storage Tank program in accordance with Section 4
3 of this Act and Section 22.12 of the Environmental Protection
4 Act.
5     10. To expend state and federal funds as appropriated by
6 the General Assembly.
7     11. To provide technical assistance, to areas not located
8 in a fire protection district or in a municipality which
9 provides fire protection service, to form a fire protection
10 district, to join an existing district, or to establish a
11 municipal fire department, whichever is applicable.
12     12. To exercise such other powers and duties as may be
13 vested in the Office by law.
