SYNOPSIS AS INTRODUCED:

625 ILCS 5/11-213 new

Amends the Illinois Vehicle Code. Provides that a peace officer who stops a vehicle for a violation or suspected violation of any law or ordinance, if he or she determines that an occupant of the vehicle is a sexual predator, shall verify that the address provided to the officer by that person is the same address the person provided to local law enforcement in accordance with the Sex Offender Registration Act. Provides that a peace officer who has been provided an incorrect address has probable cause to arrest the person for violation of the Sex Offender Registration Act, unless the person shows that he or she has changed his or her address within the 10 days allowed by that Act.

A BILL FOR

AN ACT concerning transportation.

Be it enacted by the People of the State of Illinois, represented in the General Assembly:

Section 5. The Illinois Vehicle Code is amended by adding Section 11-213 as follows:

Sec. 11-213. Traffic stops; sexual predators.

(a) A peace officer who stops a vehicle for a violation or suspected violation of this Code or any other State law or local ordinance, if he or she determines that an occupant of the vehicle is a sexual predator as defined in subsection (E) of Section 2 of the Sex Offender Registration Act, shall verify that the address provided to the officer by that person is the same address the person provided to the local chief of police or sheriff in accordance with Section 3 of the Sex Offender Registration Act.

(b) A peace officer who has been provided an incorrect address under subsection (a) of this Section has probable cause to arrest the person for violation of the Sex Offender Registration Act, unless the person shows that he or she has changed his or her address within the previous 10 days, as provided in Section 6 of that Act.
