SYNOPSIS AS INTRODUCED:
 
5 ILCS 220/3   from Ch. 127, par. 743

    Amends the Intergovernmental Cooperation Act. Provides that it is not intended that an intergovernmental agency become a suable entity and that the Act shall not be construed to affect already existing rights or liabilities.

1     AN ACT concerning government.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Intergovernmental Cooperation Act is
5 amended by changing Section 3 as follows:
 
6     (5 ILCS 220/3)  (from Ch. 127, par. 743)
7     Sec. 3. Intergovernmental cooperation. Any power or
8 powers, privileges, functions, or authority exercised or which
9 may be exercised by a public agency of this State may be
10 exercised, combined, transferred, and enjoyed jointly with any
11 other public agency of this State and jointly with any public
12 agency of any other state or of the United States to the extent
13 that laws of such other state or of the United States do not
14 prohibit joint exercise or enjoyment and except where
15 specifically and expressly prohibited by law. This includes,
16 but is not limited to, (i) arrangements between the Illinois
17 Student Assistance Commission and agencies in other states
18 which issue professional licenses and (ii) agreements between
19 the Illinois Department of Public Aid and public agencies for
20 the establishment and enforcement of child support orders and
21 for the exchange of information that may be necessary for the
22 enforcement of those child support orders. It is not intended
23 that intergovernmental agencies created under this Section
24 become suable entities. Nothing in this Act shall be construed
25 to affect the rights or liabilities that existed before the
26 creation of an intergovernmental agency.
