    Amends the Counties Code. Allows any county board of health to declare a water emergency and to regulate well use in the areas affected by the water emergency. Effective immediately.

1     AN ACT concerning local government.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Counties Code is amended by adding Section
5 5-15023 as follows:
 
6     (55 ILCS 5/5-15023 new)
7     Sec. 5-15023. Water emergencies; well use. A county board
8 of health may declare a water emergency within the county. If a
9 board of health declares a water emergency under this Section,
10 it may regulate well use within the area affected by the water
11 emergency. For the purposes of this Section, "water emergency"
12 means a critical event or series of events that disrupts the
13 availability of clean drinking water, including, but not
14 limited to, drought, overuse, and contamination of the water
15 supply. The county shall have the power to enforce any
16 regulations adopted under this Section.
 
17     Section 99. Effective date. This Act takes effect upon
18 becoming law.
