SYNOPSIS AS INTRODUCED:

55 ILCS 5/5-15023 new

Amends the Counties Code. Allows any county board of health to declare a water emergency and to regulate well use in the areas affected by the water emergency. Effective immediately.

Be it enacted by the People of the State of Illinois, represented in the General Assembly:

Section 5. The Counties Code is amended by adding Section 5-15023 as follows:

(55 ILCS 5/5-15023 new)

Sec. 5-15023. Water emergencies; well use. A county board of health may declare a water emergency within the county. If a board of health declares a water emergency under this Section, it may regulate well use within the area affected by the water emergency. For the purposes of this Section, "water emergency" means a critical event or series of events that disrupts the availability of clean drinking water, including, but not limited to, drought, overuse, and contamination of the water supply. The county shall have the power to enforce any regulations adopted under this Section.

Section 99. Effective date. This Act takes effect upon becoming law.
