1     AN ACT concerning the Township Code.

2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:

4     Section 5. The Township Code is amended by adding Section
5 115-66 as follows:

6     (60 ILCS 1/115-66 new)
7     Sec. 115-66. Surplus for maintenance and operation of open
8 spaces. A township that has adopted an open space plan may
9 maintain and receive from year to year funds for maintenance
10 and operation of the township's open spaces in surplus of the
11 amount necessary for the annual maintenance and operation of
12 open spaces within the township. The surplus shall be
13 maintained in a separate fund and not commingled with the
14 township general fund. The surplus shall not be derived from
15 any township tax levy.

16     Section 99. Effective date. This Act takes effect upon
17 becoming law.
