SYNOPSIS AS INTRODUCED:
 
410 ILCS 45/6   from Ch. 111 1/2, par. 1306

    Amends the Lead Poisoning Prevention Act. Requires any person selling paint or paint removal supplies to post a notice (i) warning of the dangers of lead-based paint dust and (ii) informing of the importance of lead-safe work practices. Requires the notice to provide telephone numbers to call for more information. Requires the Department of Public Health to adopt rules establishing the information to be contained in the notices.

1     AN ACT concerning health.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Lead Poisoning Prevention Act is amended by
5 changing Section 6 as follows:
 
6     (410 ILCS 45/6)  (from Ch. 111 1/2, par. 1306)
7     Sec. 6. Warning statement. No person, firm, or corporation
8 shall have, offer for sale, sell, or give away any lead bearing
9 substance that may be used by the general public unless it
10 bears the warning statement as prescribed by federal
11 regulation. If no regulation is prescribed the warning
12 statement shall be as follows: "WARNING--CONTAINS LEAD. DRIED
13 FILM OF THIS SUBSTANCE MAY BE HARMFUL IF EATEN OR CHEWED. See
14 Other Cautions on (Side or Back) Panel. Do not apply on toys,
15 or other children's articles, furniture, or interior, or
16 exterior exposed surfaces of any residential building or
17 facility that may be occupied or used by children. KEEP OUT OF
18 THE REACH OF CHILDREN."
19     (a) The generic term of a product, such as "paint" may be
20 substituted for the word "substance" in the above labeling.
21     (b) The placement, conspicuousness, and contrast of the
22 above labeling shall be in accordance with Section 191.101 of
23 the regulations promulgated under the provisions of the Federal
24 Hazardous Substances Act.
25     (c) Any person selling paint or paint removal supplies in
26 this State shall post a notice (i) warning of the dangers of
27 lead-based paint dust and (ii) informing of the importance of
28 lead-safe work practices. Notices posted pursuant to this
29 subsection (c) shall contain telephone numbers of federal and
30 State agencies that consumers can call for more information.
31     The Department shall adopt rules establishing the
32 information to be contained in the notices required by this
