    Amends the Fire Sprinkler Dormitory Act. Defines "dormitory". Provides that fire sprinkler systems are required in the dormitories of all post-secondary educational institutions by January 1, 2013 (now, fire sprinkler systems are required by 2013 if a fire sprinkler dormitory revolving loan program is established). Allows post-secondary educational institutions to collect a fee of $5 per credit hour from each student residing in a dormitory, which fees must be transmitted to the Office of the State Fire Marshal to be deposited into the Fire Sprinkler Dormitory Revolving Loan Fund.

1     AN ACT concerning dormitories.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Fire Sprinkler Dormitory Act is amended by
5 changing Sections 5, 10, and 15 and by adding Section 20 as
6 follows:

8     Sec. 5. Definitions. Definition.
9     "Dormitory" means any building or structure that is owned
10 or leased by a post-secondary educational institution and that
11 has an occupancy of more than 4 sleeping rooms, with or without
12 cooking facilities.
13     "Post-secondary educational institution" means an Illinois
14 public or private college or university offering degrees and
15 instruction above the high school level. This term does not
16 include any public or private college or university that does
17 not provide on-campus housing for its students in dormitories
18 or equivalent facilities that are owned, operated, or
19 maintained by the public or private college or university. This
20 term does not include (i) any public or private junior or
21 community college or (ii) any institution offering degrees and
22 instruction that uses correspondence as its primary mode of
23 student instruction.

26     Sec. 10. Fire sprinkler systems required. Fire Subject to
27 the establishment of a fire sprinkler dormitory revolving loan
28 program under Section 15 of this Act, fire sprinkler systems
29 are required in the dormitories of all post-secondary
30 educational institutions by January 1, 2013. This includes
31 current structures as well as newly constructed dormitories.

1 Nothing in this Act may be construed to abrogate any statute,
2 rule, or ordinance requiring that a fire extinguisher be
3 present in a dormitory.

6     Sec. 15. Fire Sprinkler Dormitory Revolving Loan Program.
7 The Illinois Finance Authority and the Office of the State Fire
8 Marshal shall jointly administer a fire sprinkler dormitory
9 revolving loan program. The program shall provide low-interest
10 loans for the installation of fire sprinkler systems in college
11 dormitories by post-secondary educational institutions. The
12 loan funds, subject to appropriation or other funding sources,
13 shall be paid out of the Fire Sprinkler Dormitory Revolving
14 Loan Fund, a special fund in the State treasury. The Fund shall
15 consist of any moneys transferred into or appropriated to the
16 Fund as well as all repayments of loans made under this Section
17 and fees collected under Section 20 of this Act. The Fund shall
18 be used for loans to post-secondary educational institutions
19 for costs associated with the installation of fire sprinkler
20 systems in dormitories and for no other purpose. All interest
21 earned on moneys in the Fund shall be deposited into the Fund.

24     Sec. 20. Fee. Post-secondary educational institutions are
25 authorized to collect a fee of $5 per credit hour from each
26 student residing in a dormitory. The fees collected must be
27 transmitted to the Office of the State Fire Marshal, to be
28 deposited into the Fire Sprinkler Dormitory Revolving Loan
29 Fund. The fees may be used only for those purposes set forth in
30 Section 15 of this Act.
