1     AN ACT concerning gaming.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Riverboat Gambling Act is amended by adding
5 Section 13.2 as follows:
 
6     (230 ILCS 10/13.2 new)
7     Sec. 13.2. Rialto Square Theatre Improvement Fund. In
8 addition to any other monies required to be paid under this
9 Act, a riverboat with a home dock located within the City of
10 Joliet shall pay to the Illinois Gaming Board $1,500,000 on
11 July 1, 2006 or within 30 days after the effective date of this
12 amendatory Act of the 94th General Assembly, whichever is
13 later. The payments required under this Section shall be
14 deposited into the Rialto Square Theatre Improvement Fund, a
15 special fund created in the State treasury. Subject to
16 appropriation to the governing board of the Will County
17 Metropolitan Exposition and Auditorium Authority, moneys in
18 the Rialto Square Theatre Improvement Fund shall be used for
19 repairs and improvements to the Rialto Square Theatre.
 
20     Section 10. The State Finance Act is amended by adding
21 Section 5.663 and by amending Section 8h as follows:

23     Sec. 5.663. The Rialto Square Theatre Improvement Fund.

25     Sec. 8h. Transfers to General Revenue Fund.
26     (a) Except as provided in subsection (b), notwithstanding
27 any other State law to the contrary, the Governor may, through
28 June 30, 2007, from time to time direct the State Treasurer and
29 Comptroller to transfer a specified sum from any fund held by

1 the State Treasurer to the General Revenue Fund in order to
2 help defray the State's operating costs for the fiscal year.
3 The total transfer under this Section from any fund in any
4 fiscal year shall not exceed the lesser of (i) 8% of the
5 revenues to be deposited into the fund during that fiscal year
6 or (ii) an amount that leaves a remaining fund balance of 25%
7 of the July 1 fund balance of that fiscal year. In fiscal year
8 2005 only, prior to calculating the July 1, 2004 final
9 balances, the Governor may calculate and direct the State
10 Treasurer with the Comptroller to transfer additional amounts
11 determined by applying the formula authorized in Public Act
12 93-839 to the funds balances on July 1, 2003. No transfer may
13 be made from a fund under this Section that would have the
14 effect of reducing the available balance in the fund to an
15 amount less than the amount remaining unexpended and unreserved
16 from the total appropriation from that fund estimated to be
17 expended for that fiscal year. This Section does not apply to
18 any funds that are restricted by federal law to a specific use,
19 to any funds in the Motor Fuel Tax Fund, the Intercity
20 Passenger Rail Fund, the Hospital Provider Fund, the Medicaid
21 Provider Relief Fund, the Teacher Health Insurance Security
22 Fund, the Reviewing Court Alternative Dispute Resolution Fund,
23 or the Voters' Guide Fund, the Foreign Language Interpreter
24 Fund, the Lawyers' Assistance Program Fund, the Supreme Court
25 Federal Projects Fund, the Supreme Court Special State Projects
26 Fund, or the Low-Level Radioactive Waste Facility Development
27 and Operation Fund, or the Hospital Basic Services Preservation
28 Fund, or to any funds to which subsection (f) of Section 20-40
29 of the Nursing and Advanced Practice Nursing Act applies. No
30 transfers may be made under this Section from the Pet
31 Population Control Fund. Notwithstanding any other provision
32 of this Section, for fiscal year 2004, the total transfer under
33 this Section from the Road Fund or the State Construction
34 Account Fund shall not exceed the lesser of (i) 5% of the
35 revenues to be deposited into the fund during that fiscal year
36 or (ii) 25% of the beginning balance in the fund. For fiscal

1 year 2005 through fiscal year 2007, no amounts may be
2 transferred under this Section from the Road Fund, the State
3 Construction Account Fund, the Criminal Justice Information
4 Systems Trust Fund, the Wireless Service Emergency Fund, or the
5 Mandatory Arbitration Fund.
6     In determining the available balance in a fund, the
7 Governor may include receipts, transfers into the fund, and
8 other resources anticipated to be available in the fund in that
9 fiscal year.
10     The State Treasurer and Comptroller shall transfer the
11 amounts designated under this Section as soon as may be
12 practicable after receiving the direction to transfer from the
13 Governor.
14     (b) This Section does not apply to: (i) the Ticket For The
15 Cure Fund; (ii) or to any fund established under the Community
16 Senior Services and Resources Act; or (iii) (ii) on or after
17 January 1, 2006 (the effective date of Public Act 94-511) this
18 amendatory Act of the 94th General Assembly, the Child Labor
19 and Day and Temporary Labor Enforcement Fund.
20     (c) This Section does not apply to the Demutualization
21 Trust Fund established under the Uniform Disposition of
22 Unclaimed Property Act.
23     (d) This Section does not apply to the Rialto Square
24 Theatre Fund established under the Riverboat Gambling Act.

32     Section 99. Effective date. This Act takes effect upon
33 becoming law.
