1     AN ACT concerning business.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Consumer Fraud and Deceptive Business
5 Practices Act is amended by adding Section 2XX as follows:
 
6     (815 ILCS 505/2XX new)
7     Sec. 2XX. Work-at-home solicitations. No person shall
8 advertise, represent or imply that any person can earn money
9 working at home by stuffing envelopes, addressing envelopes,
10 mailing circulars, clipping newspaper and magazine articles,
11 assembling products, bill processing, or performing similar
12 work, unless the person making the advertisement or
13 representation:
14         (1) actually pays the advertised wage, salary, set fee,
15     or commission to others for performing the represented
16     tasks;
17         (2) at no time requires the person who will perform the
18     represented tasks to purchase instructional booklets,
19     brochures, kits, programs, materials, mailing lists,
20     directories, memberships in cooperative associations, or
21     other similar items or services;
22         (3) discloses the legal name under which business is
23     conducted and the complete street address from which
24     business is actually conducted in all advertising and
25     promotional materials, including order blanks and forms;
26     and
27         (4) discloses in writing to the person who will perform
28     the represented tasks an exact description of the work to
29     be performed, the amount of any wage, salary, set fee, or
30     commission to be paid for the performance of the
31     represented tasks, and all terms and conditions for earning
32     such wage, salary, set fee, or commission.

1     No person shall require an individual to solicit or induce
2 other individuals to participate in a work-at-home program.
3     A person who violates this Section commits an unlawful
4 practice within the meaning of this Act.
 
5     Section 99. Effective date. This Act takes effect upon
6 becoming law.
