SYNOPSIS AS INTRODUCED:
 
65 ILCS 5/11-15.1-2.1   from Ch. 24, par. 11-15.1-2.1

    Amends the Illinois Municipal Code. In provisions concerning municipal jurisdiction over property subject to an annexation agreement, deletes exemptions based on population and instead specifically exempts the following: Cook, Dekalb, DuPage, Kane, Kendell, Lake, Madison, McHenry, St. Clair, McLean, Tazewell, Will, and Winnebago Counties. Effective immediately.

1     AN ACT concerning local government.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Illinois Municipal Code is amended by
5 changing Section 11-15.1-2.1 as follows:
 
6     (65 ILCS 5/11-15.1-2.1)  (from Ch. 24, par. 11-15.1-2.1)
7     Sec. 11-15.1-2.1. Annexation agreement; municipal
8 jurisdiction.
9     (a) Property that is the subject of an annexation agreement
10 adopted under this Division is subject to the ordinances,
11 control, and jurisdiction of the annexing municipality in all
12 respects the same as property that lies within the annexing
13 municipality's corporate limits.
14     (b) This Section shall not apply in Cook, Dekalb, DuPage,
15 Kane, Kendell, Lake, Madison, McHenry, St. Clair, McLean,
16 Tazewell, Will, and Winnebago Counties (i) a county with a
17 population of more than 3,000,000, (ii) a county that borders a
18 county with a population of more than 3,000,000 or (iii) a
19 county with a population of more than 246,000 according to the
20 1990 federal census and bordered by the Mississippi River,
21 unless the parties to the annexation agreement have, at the
22 time the agreement is signed, ownership or control of all
23 property that would make the property that is the subject of
24 the agreement contiguous to the annexing municipality, in which
25 case the property that is the subject of the annexation
26 agreement is subject to the ordinances, control, and
27 jurisdiction of the municipality in all respects the same as
28 property owned by the municipality that lies within its
29 corporate limits.

31     Section 99. Effective date. This Act takes effect upon
32 becoming law.
