SYNOPSIS AS INTRODUCED:
 
815 ILCS 505/2XX new

    Amends the Consumer Fraud and Deceptive Business Practices Act. Provides that any person who mails a check to a consumer that automatically obligates the consumer to receive a subscription or service on the basis of any endorsement, deposit, transfer, or other form of negotiation of that check by the consumer is guilty of an unlawful practice within the meaning of this Act.

1     AN ACT concerning consumer fraud.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Consumer Fraud and Deceptive Business
5 Practices Act is amended by adding Section 2XX as follows:
 
6     (815 ILCS 505/2XX new)
7     Sec. 2XX. Mailed check creating service or subscription
8 obligation. Any person who mails a check to a consumer that
9 automatically obligates the consumer to receive a subscription
10 or service on the basis of any endorsement, deposit, transfer,
11 or other form of negotiation of that check by the consumer is
12 guilty of an unlawful practice within the meaning of this Act.
13     For purposes of this Section, "check" means a writing that
14 complies with the requirements of Section 3-104 of the Uniform
15 Commercial Code.
