SYNOPSIS AS INTRODUCED:

750 ILCS 16/10

Amends the Non-Support Punishment Act. Makes a technical change in a Section concerning proceedings under the Act.

A BILL FOR

AN ACT concerning civil law.

Be it enacted by the People of the State of Illinois, represented in the General Assembly:

Section 5. The Non-Support Punishment Act is amended by changing Section 10 as follows:

(750 ILCS 16/10)

Sec. 10. Proceedings. Proceedings under this Act may be by indictment or information. No proceeding may be brought under Section 15 against a person whose court or administrative order for support was entered by default, unless the the indictment or information specifically alleges that the person has knowledge of the existence of the order for support and that the person has the ability to pay the support.
