New Act
30 ILCS 105/5.640 new

Creates the Rapid Reduction of Asian Carp Population Pilot Program Act. Authorizes the Department of Natural Resources, subject to appropriation, to award grants to organizations that develop and implement programs to reduce the number of Asian carp in the Illinois River. Specifies how grants may be used. Repeals the Act on July 1, 2010. Amends the State Finance Act to create a special fund in the State treasury for the funding of the grants. Effective immediately.

AN ACT concerning fish.

Be it enacted by the People of the State of Illinois, represented in the General Assembly:

Section 1. Short title. This Act may be cited as the Rapid Reduction of Asian Carp Population Pilot Program Act.

Section 5. Definitions. As used in this Act:

"Department" means the Department of Natural Resources.

"Director" means the Director of Natural Resources.

Section 10. Rapid reduction of Asian carp population grants.

(a) Subject to appropriation, the Department of Natural Resources may award grants to organizations for the development and implementation of programs to reduce the number of Asian carp in the Illinois River. Grants shall be funded from the Rapid Reduction of Asian Carp Fund, a special fund created in the State treasury for that purpose.

(b) Grants under this Section may be used by a recipient organization for:

(1) Payments to participants for the removal of Asian carp from the Illinois River at a cost not to exceed 12 cents per pound in the first year of the grant, 14 cents per pound in the second year of the grant, and 16 cents per pound in the remaining years of the grant.

(2) Marketing and processing of the Asian carp at a cost not to exceed 5 cents per pound in the first year of the grant, 5.5 cents per pound in the second year of the grant, and 6 cents per pound in the remaining years of the grant.

(3) Shipping and rendering of the Asian carp.

(4) Research and scientific data collection relating to Asian carp population reduction.

(5) Market development for Asian carp.

(6) Administrative expenses of the program, not to exceed 5% of the total grant amount.

(c) An organization awarded a grant under this Section shall prepare a budget that includes, but is not limited to, the probable costs of the Asian carp reduction program and of individual projects and contracts under the program. The organization shall submit the proposed budget to the Director of Natural Resources for review and comment.

(d) An organization awarded a grant under this Section shall report annually in writing to the Department upon the status of its program and upon its payments and expenses under the program. The organization's financial books and records relating to the program shall be audited at least every 2 years by a certified public accountant. The audit report shall be included in the organization's appropriate annual report to the Department.

(e) The Department shall create a project oversight committee, which shall report quarterly in writing to the Department.

Section 15. Rules. The Department shall adopt rules for the implementation and administration of this Act.

Section 20. Repeal. This Act is repealed on July 1,2010. The Department shall not award grants under Section 10 for periods beyond June 30, 2010.

Section 95. The State Finance Act is amended by adding Section 5.640 as follows:

Section 99. Effective date. This Act takes effect July 1, 2005.
