SYNOPSIS AS INTRODUCED:

215 ILCS 5/155.42 new

Amends the Illinois Insurance Code. Prohibits an insurance company offering life insurance from refusing to issue or renew a life insurance policy on the basis of the applicant or insured having voluntarily admitted himself or herself into a drug or alcohol rehabilitation program during the time the person is in the program and for 5 years after the person is discharged or checks out of the program. Effective immediately.

A BILL FOR

AN ACT concerning insurance.

Be it enacted by the People of the State of Illinois, represented in the General Assembly:

Section 5. The Illinois Insurance Code is amended by adding Section 155.42 as follows:

(215 ILCS 5/155.42 new)

Sec. 155.42. Refusal to provide life insurance on the basis of voluntary admission into a drug or alcohol rehabilitation program. No company authorized in this State to write a policy of life insurance may refuse to issue or renew a policy of life insurance on the basis that the applicant or insured was voluntarily admitted into a program for drug or alcohol rehabilitation. This prohibition extends from the time that the applicant or insured is admitted to the program to 5 years after the applicant or insured checks out or is discharged from the program.

Section 99. Effective date. This Act takes effect upon becoming law.
