1 AN ACT concerning transportation.
2 Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
4 Section 5. The Regional Transportation Authority Act is
5 amended by changing Section 3.01 as follows:
6 (70 ILCS 3615/3.01) (from Ch. 111 2/3, par. 703.01)
7 Sec. 3.01. Board of Directors. Upon expiration of the
8 term of the members of the Transition Board as provided for
9 in Section 3.09, the corporate authorities and governing body
10 of the Authority shall be a Board consisting of 13 Directors
11 appointed as follows:
12 (a) ThreeFour Directors appointed by the Mayor of the
13 City of Chicago, with the advice and consent of the City
14 Council of the City of Chicago, and a fourthfifth director
15 who shall be the Chairman of the Chicago Transit Authority.
16 Each such Director shall reside in the City of Chicago except
17 the Chairman of the Chicago Transit Authority who shall
18 reside within the metropolitan area as defined in the
19 Metropolitan Transit Authority Act.
20 (b) Four Directors appointed by the members of the Cook
21 County Board elected from that part of Cook County outside of
22 Chicago, or, in the event such Board of Commissioners becomes
23 elected from single member districts, by those Commissioners
24 elected from districts, a majority of the electors of which
25 reside outside Chicago. In either case, such appointment
26 shall be with the concurrence of four such Commissioners.
27 Each such Director shall reside in that part of Cook County
28 outside Chicago.
29 (c) ThreeTwo Directors appointed by the Chairmen of the
30 county boards of Kane, Lake, McHenry, and Will Counties, with
31 the concurrence of not less than a majority of the Chairmen

1 from such counties, from nominees by the Chairmen. Each such
2 Chairman may nominate not more than 2 persons for each
3 position. Each such Director shall reside in a county in the
4 metropolitan region other than Cook or DuPage Counties.
5 (d) One Director shall be appointed by the Chairman of
6 the Board of DuPage County with the advice and consent of the
7 County Board of DuPage County and shall reside in DuPage
8 County.
9 (e) Before January 1, 1987, for the term expiring July
10 1, 1989, the Chairman shall be appointed by the Governor.
11 Thereafter the Chairman shall be appointed by the other 12
12 Directors with the concurrence of three-fourths of such
13 Directors. The chairman shall not be appointed from among the
14 other Directors. The chairman shall be a resident of the
15 metropolitan region.
16 (f) Except as otherwise provided by this Act no Director
17 shall, while serving as such, be an officer, a member of the
18 Board of Directors or Trustees or an employee of any
19 transportation agency, or be an employee of the State of
20 Illinois or any department or agency thereof, or of any unit
21 of local government or receive any compensation from any
22 elected or appointed office under the Constitution and laws
23 of Illinois; except that a Director may be a member of a
24 school board.
25 (g) Each appointment made under this Section and under
26 Section 3.03 shall be certified by the appointing authority
27 to the Board, which shall maintain the certifications as part
28 of the official records of the Authority; provided that the
29 initial appointments shall be certified to the Secretary of
30 State, who shall transmit the certifications to the Board
31 following its organization. All appointments made by the
32 Governor shall be made with the advice and consent of the
33 Senate.
34 (h) The Board of Directors shall be so appointed as to

1 represent the City of Chicago, that part of Cook County
2 outside the City of Chicago, and that part of the
3 metropolitan region outside Cook County on the one man one
4 vote basis. After each Federal decennial census the General
5 Assembly shall review the composition of the Board and, if a
6 change is needed to comply with this requirement, shall
7 provide for the necessary revision by July 1 of the third
8 year after such census. Provided, however, that the Chairman
9 of the Chicago Transit Authority shall be a Director of the
10 Authority and shall be considered as representing the City of
11 Chicago for purposes of this paragraph.
12 Insofar as may be practicable, the changes in Board
13 membership necessary to achieve this purpose, including the
14 purpose of this amendatory Act of the 93rd General Assembly,
15 shall take effect as appropriate members terms expire, no
16 member's term being reduced by reason of such revision of the
17 composition of the Board.

19 Section 99. Effective date. This Act takes effect upon
20 becoming law.
