SYNOPSIS AS INTRODUCED:
 
105 ILCS 145/27

    Amends the Care of Students with Diabetes Act. Provides that a school shall maintain a supply of glucagon in any secure location that is immediately accessible to a school nurse or a delegated care aide if a student diagnosed with diabetes attends the school. Provides that schools shall obtain a prescription for glucagon, even if the school is not required to maintain the glucagon.

1    AN ACT concerning education.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Care of Students with Diabetes Act is
5amended by changing Section 27 as follows:
 
6    (105 ILCS 145/27)
7    Sec. 27. Undesignated glucagon. A school may maintain a
8supply of glucagon in any secure location that is immediately
9accessible to a school nurse or a delegated care aide;
10however, a school shall maintain a supply of glucagon in any
11secure location that is immediately accessible to a school
12nurse or a delegated care aide if a student diagnosed with
13diabetes attends the school. Schools shall obtain a
14prescription for glucagon, even if the school is not required
15to maintain the glucagon. A physician, a physician assistant
16who has prescriptive authority under Section 7.5 of the
17Physician Assistant Practice Act of 1987, or an advanced
18practice registered nurse who has prescriptive authority under
19Section 65-40 of the Nurse Practice Act may prescribe
20undesignated glucagon in the name of the school to be
21maintained for use when necessary. Any supply of undesignated
22glucagon must be maintained in accordance with the
23manufacturer's instructions. A school nurse or delegated care

1aide may administer undesignated glucagon if he or she is
2authorized to administer the undesignated glucagon through a
3student's diabetes care plan and if the student's prescribed
4glucagon is not available on-site or has expired. Immediately
5after the administration of undesignated glucagon, a school
6must notify the school nurse, unless the school nurse was the
7one administering the undesignated glucagon, and the student's
8parent or guardian or emergency contact, if known, and health
9care provider of its use.
