SYNOPSIS AS INTRODUCED:
 
725 ILCS 5/102-7.1

    Amends the Code of Criminal Procedure of 1963. In the definition of "Category A offense" for bail and pretrial release purposes, includes aggravated fleeing or attempting to elude a peace officer, escape, and violation of bail bond or pretrial release.

1    AN ACT concerning criminal law.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Code of Criminal Procedure of 1963 is
5amended by changing Section 102-7.1 as follows:
 
6    (725 ILCS 5/102-7.1)
7    (Text of Section before amendment by P.A. 102-982)
8    Sec. 102-7.1. "Category A offense". "Category A offense"
9means a Class 1 felony, Class 2 felony, Class X felony, first
10degree murder, a violation of Section 11-204 or 11-204.1 of
11the Illinois Vehicle Code, a second or subsequent violation of
12Section 11-501 of the Illinois Vehicle Code, a violation of
13subsection (d) of Section 11-501 of the Illinois Vehicle Code,
14a violation of Section 11-401 of the Illinois Vehicle Code if
15the accident results in injury and the person failed to report
16the accident within 30 minutes, a violation of Section 9-3,
179-3.4, 10-3, 10-3.1, 10-5, 11-6, 11-9.2, 11-20.1, 11-23.5,
1811-25, 12-2, 12-3, 12-3.05, 12-3.2, 12-3.4, 12-4.4a, 12-5,
1912-6, 12-7.1, 12-7.3, 12-7.4, 12-7.5, 12C-5, 24-1.1, 24-1.5,
2024-3, 25-1, 26.5-2, 31-6, 32-10, or 48-1 of the Criminal Code
21of 2012, a second or subsequent violation of 12-3.2 or 12-3.4
22of the Criminal Code of 2012, a violation of paragraph (5) or
23(6) of subsection (b) of Section 10-9 of the Criminal Code of

12012, a violation of subsection (b) or (c) or paragraph (1) or
2(2) of subsection (a) of Section 11-1.50 of the Criminal Code
3of 2012, a violation of Section 12-7 of the Criminal Code of
42012 if the defendant inflicts bodily harm on the victim to
5obtain a confession, statement, or information, a violation of
6Section 12-7.5 of the Criminal Code of 2012 if the action
7results in bodily harm, a violation of paragraph (3) of
8subsection (b) of Section 17-2 of the Criminal Code of 2012, a
9violation of subdivision (a)(7)(ii) of Section 24-1 of the
10Criminal Code of 2012, a violation of paragraph (6) of
11subsection (a) of Section 24-1 of the Criminal Code of 2012, a
12first violation of Section 24-1.6 of the Criminal Code of 2012
13by a person 18 years of age or older where the factors listed
14in both items (A) and (C) or both items (A-5) and (C) of
15paragraph (3) of subsection (a) of Section 24-1.6 of the
16Criminal Code of 2012 are present, a Class 3 felony violation
17of paragraph (1) of subsection (a) of Section 2 of the Firearm
18Owners Identification Card Act, or a violation of Section 10
19of the Sex Offender Registration Act.

610-3, 10-3.1, 10-5, 11-6, 11-9.2, 11-20.1, 11-23.5, 11-25,
712-2, 12-3, 12-3.05, 12-3.2, 12-3.4, 12-4.4a, 12-5, 12-6,
812-7.1, 12-7.3, 12-7.4, 12-7.5, 12C-5, 24-1.1, 24-1.5, 24-3,
925-1, 26.5-2, 31-6, 32-10, or 48-1 of the Criminal Code of
102012, a second or subsequent violation of 12-3.2 or 12-3.4 of
11the Criminal Code of 2012, a violation of paragraph (5) or (6)
12of subsection (b) of Section 10-9 of the Criminal Code of 2012,
13a violation of subsection (b) or (c) or paragraph (1) or (2) of
14subsection (a) of Section 11-1.50 of the Criminal Code of
152012, a violation of Section 12-7 of the Criminal Code of 2012
16if the defendant inflicts bodily harm on the victim to obtain a
17confession, statement, or information, a violation of Section
1812-7.5 of the Criminal Code of 2012 if the action results in
19bodily harm, a violation of paragraph (3) of subsection (b) of
20Section 17-2 of the Criminal Code of 2012, a violation of
21subdivision (a)(7)(ii) of Section 24-1 of the Criminal Code of
222012, a violation of paragraph (6) of subsection (a) of
23Section 24-1 of the Criminal Code of 2012, a first violation of
24Section 24-1.6 of the Criminal Code of 2012 by a person 18
25years of age or older where the factors listed in both items
26(A) and (C) or both items (A-5) and (C) of paragraph (3) of

1subsection (a) of Section 24-1.6 of the Criminal Code of 2012
2are present, a Class 3 felony violation of paragraph (1) of
3subsection (a) of Section 2 of the Firearm Owners
4Identification Card Act, or a violation of Section 10 of the
5Sex Offender Registration Act.

7    Section 95. No acceleration or delay. Where this Act makes
8changes in a statute that is represented in this Act by text
9that is not yet or no longer in effect (for example, a Section
10represented by multiple versions), the use of that text does
11not accelerate or delay the taking effect of (i) the changes
12made by this Act or (ii) provisions derived from any other
13Public Act.
