SYNOPSIS AS INTRODUCED:

10 ILCS 5/29-21 new

Amends the Election Code. Provides that a person commits a Class A misdemeanor if the person, with intent to injure a candidate or influence the result of an election, creates a deep fake video (a video created with the intent to deceive that appears to depict a real person performing an action that did not occur in reality) and causes the deep fake video to be published or distributed within 30 days of an election.

A BILL FOR

AN ACT concerning elections.

Be it enacted by the People of the State of Illinois, represented in the General Assembly:

Section 5. The Election Code is amended by adding Section 29-21 as follows:

(10 ILCS 5/29-21 new)

Sec. 29-21. Deep fake videos.

(a) As used in this Section, "deep fake video" means a video created, with the intent to deceive, that appears to depict a real person performing an action that did not occur in reality.

(b) A person commits a Class A misdemeanor if the person, with intent to injure a candidate or influence the result of an election:

(1) creates a deep fake video; and

(2) causes the deep fake video to be published or distributed within 30 days of an election.
