SYNOPSIS AS INTRODUCED:
 
615 ILCS 5/35

    Amends the Rivers, Lakes and Streams Act. Provides that the Department of Natural Resources shall collect a fee of up to $5,000 annually per Lake Michigan water allocation permit issued under the Act. Provides that fees collected under the Act shall be deposited into the State Boating Act Fund for use by the Department for water allocation monitoring and water supply planning.

1    AN ACT concerning transportation.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Rivers, Lakes, and Streams Act is amended
5by changing Section 35 as follows:
 
6    (615 ILCS 5/35)
7    Sec. 35. Permit fees. The Department of Natural Resources
8shall collect a fee of up to $5,000 per application for permits
9and annually per Lake Michigan water allocation permit issued
10under this Act. The Department of Natural Resources shall set
11the specific fee applicable to different permits and water
12allocation permits issued under this Act by administrative
13rule, provided that no fee exceeds $5,000. All fees collected
14pursuant to this Section shall be deposited in the State
15Boating Act Fund for use by the Department of Natural
16Resources for water allocation monitoring, water supply
17planning, and the ordinary and contingent expenses of the
18Department of Natural Resources. No permit application shall
19be processed until the application fee is paid to the
20Department of Natural Resources. The monies deposited into the
21State Boating Act Fund under this Section shall not be subject
22to administrative charges or chargebacks unless otherwise
23authorized by this Act.
