SYNOPSIS AS INTRODUCED:
 
70 ILCS 2605/3  from Ch. 42, par. 322

    Amends the Metropolitan Water Reclamation District Act. Requires the advice and consent of the Senate for Governor appointments to fill a trustee vacancy in the Metropolitan Water Reclamation District. Provides that if, during a recess of the Senate, there is a vacancy in an office of trustee, the Governor shall make a temporary appointment until the next meeting of the Senate when the Governor shall make a nomination to fill the vacant office. Effective immediately.

1    AN ACT concerning local government.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Metropolitan Water Reclamation District Act
5is amended by changing Section 3 as follows:
 
6    (70 ILCS 2605/3)  (from Ch. 42, par. 322)
7    Sec. 3. The corporate authority of the Sanitary District
8of Chicago shall consist of nine trustees. Such trustees shall
9be elected for staggered terms at the election provided by the
10general election law. Three trustees shall be elected at each
11such election to succeed the 3 trustees whose terms expire in
12such year.
13    Such trustees shall take office on the first Tuesday after
14the first Monday in the month following the month of their
15election and shall hold their offices for six years and until
16their successors shall be elected and qualified. In all
17elections for trustees each elector may vote for as many
18candidates as there are trustees to be elected, but no elector
19may give to such candidates more than one vote, it being the
20intent and purpose of this Act to prohibit cumulative voting
21in the selection of members of the board of the sanitary
22district.
23    The election of trustees shall be in accordance with the

1provisions of the general election law.
2    By reason of the importance and character of the services
3performed by the sanitary district, there is a great need and
4it is in the public interest that such services be performed in
5as near a non-partisan character as possible.
6    When a vacancy exists in the office of trustees of any
7sanitary district organized under the provisions hereof, the
8vacancy shall be filled by appointment by the Governor, by and
9with the advice and consent of the Senate, until the next
10regular election at which trustees of the Sanitary District of
11Chicago are elected, and thereafter until a successor shall be
12elected and qualified. If, during a recess of the Senate,
13there is a vacancy in an office of trustee, the Governor shall
14make a temporary appointment until the next meeting of the
15Senate when the Governor shall make a nomination to fill the
16vacant office.
17    Such sanitary district shall from the time of the first
18election held by it under this Act be construed in all courts
19to be a body corporate and politic, and by the name and style
20of the sanitary district of...., and by such name and style may
21sue and be sued, contract and be contracted with, acquire and
22hold real estate and personal property necessary for corporate
23purposes, and adopt a common seal and alter the same at
24pleasure.
25    The board of trustees shall have the power to change the
26name of the Sanitary District of Chicago by ordinance and

1public notice without impairing the legal status of acts
2theretofore performed by said district. Thereafter any and all
3references to the Sanitary District of Chicago in this Act or
4otherwise shall mean and include the name under which such
5sanitary district is then operating. No rights, duties or
6privilege of such a sanitary district, or those of any person,
7existing before the change of name shall be affected by a
8change, in the name of a sanitary district. All proceedings
9pending in any court in favor of or against such sanitary
10district may continue to final consummation under the name in
11which they were commenced.

13    Section 99. Effective date. This Act takes effect upon
14becoming law.
