HOUSE RESOLUTION

 
2    WHEREAS, Illinois' 1.2 million small business owners, and
3the 2.5 million small business employees, deserve action from
4every State agency covered under the Business Assistance and
5Regulatory Reform Act, 20 ILCS 608, regarding the submission
6of a statutorily mandated 5-year review of their rules,
7regulations, and processes on small businesses to the Office
8of Business Permits and Regulatory Assistance as indicated
9under 20 ILCS 608/20; and
 
10    WHEREAS, The only State agencies to submit a report in
112022 were the Capital Development Board, the Department of
12Central Management Services, the Department of Commerce and
13Economic Opportunity, the Department of Employment Security,
14the Department of Human Rights, the Department of Juvenile
15Justice, the Department of Transportation, the Department of
16Revenue, the Governor's Office of Management and Budget, the
17Human Rights Commission, the Illinois Environmental Protection
18Agency, the Illinois Lottery, the Illinois Workers'
19Compensation Commission, and the Office of the Illinois
20Attorney General; and
 
21    WHEREAS, State agencies that did not submit a report in
222022 include the Banking Board of Illinois, the Business
23Enterprise Council for Minorities, Females, and Persons with

1Disabilities, the Cannabis Commission, the Climate Change
2Advisory Council, the Commission on Equity and Inclusion, the
3Elevator Safety Review Board, the Department of Agriculture,
4the Department of Financial and Professional Regulation, the
5Department of Innovation and Technology, the Department of
6Insurance, the Department of Labor, the Department of Natural
7Resources, the Department of Public Health, the Enterprise
8Zone Board, the Future of Work Task Force, the Hispanic
9Employment Plan Advisory Council, the Illinois Finance
10Authority, the Illinois Gaming Board, the Illinois Institute
11for Entrepreneurship Education, the Labor Advisory Board, the
12Labor Relations Board, the Liquor Control Commission, the Main
13Street Advisory Council, the Pollution Control Board, the
14Procurement Policy Board, the Property Tax Appeal Board, the
15Illinois Racing Board, the Illinois State Toll Highway
16Authority, the Illinois Workforce Innovation Board, the
17Illinois Works Review Panel, and the Office of Illinois State
18Treasurer; and
 
19    WHEREAS, These State agencies should have submitted their
20small business review reports especially after such an
21unprecedented event as the COVID-19 pandemic; after the
22pandemic caused the global economy to falter into a recession,
23leaving millions unemployed, with thousands never to return to
24the workforce, and supply chains unrecoverable, COVID-19's
25impact on small businesses across the State could be felt for

1generations to come; and
 
2    WHEREAS, Furthermore, it is disappointing that the
3Pritzker administration has not publicly admonished its
4departments for not fulfilling their statutory mandates; the
5last 5-year report to be completed by every affected
6department was in 2017; while the COVID-19 pandemic was a
7hindrance on legislative and State activity in 2020, the most
8recent 5-year report was due in 2022, which was more than
9enough time for each department to submit a new report; and
 
10    WHEREAS, The effects of government on small business, from
11the federal government funds through the Coronavirus Aid,
12Relief, and Economic Security (CARES) Act and the American
13Rescue Plan Act (ARPA) to the emergency declarations putting
14curfews on businesses and designating which business were
15deemed "essential", have all affected State agencies' rules
16and regulations for small business, leaving the actions of
17these agencies to be "overtly unreasonable, unduly burdensome,
18duplicative, or onerous on small businesses" (20 ILCS 608/20
19(b)); and
 
20    WHEREAS, Now that the pandemic has ended and the economy
21has normalized, it is time for these State agencies to adhere
22to the Business Assistance and Regulatory Reform Act and be in
23accordance with its goal of the review for each State agency,

1as listed under 20 ILCS 608/20 (b), to recommend changes that
2will lessen the reporting and paper work requirements on small
3businesses while still achieving the intent of the underlying
4statute, to eliminate unnecessary or antiquated permit
5requirements, to consolidate duplicative or overlapping permit
6requirements, to simplify overly complex or lengthy
7application procedures, and to expedite time-consuming agency
8review and approval procedures; and
 
9    WHEREAS, In the Illinois House of Representatives, Rep.
10Lance Yednock has filed HB 3017, representing progress in the
11authority promised to the small business community from the
12State government that "the provisions of this Act shall not
13lessen or reduce such powers" of State government, but "shall
14modify the procedures followed in carrying out such powers"
15extended in the Act to ensure solidified cooperation between
16small business and State government; therefore, be it
 
17    RESOLVED, BY THE HOUSE OF REPRESENTATIVES OF THE ONE
18HUNDRED THIRD GENERAL ASSEMBLY OF THE STATE OF ILLINOIS, that
19we implore each of the non-submittal agencies to submit their
205-year small business regulatory review to be in compliance
21with the Business Assistance and Regulatory Reform Act, 20
22ILCS 608; and be it further
 
23    RESOLVED, That the goal of this resolution is to improve

1the State's business climate by making it easier for small and
2mid-size businesses to deal with State requirements for doing
3business; and be it further
 
4    RESOLVED, That a suitable copy of this resolution be
5delivered to Governor JB Pritzker.
