SYNOPSIS AS INTRODUCED:
 
305 ILCS 5/10-10.1  from Ch. 23, par. 10-10.1

    Amends the Illinois Public Aid Code. Makes a technical change in a Section concerning the collection fee a court may impose on an individual who owes child or spouse support.

1    AN ACT concerning public aid.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Illinois Public Aid Code is amended by
5changing Section 10-10.1 as follows:
 
6    (305 ILCS 5/10-10.1)  (from Ch. 23, par. 10-10.1)
7    Sec. 10-10.1. Public Aid Collection Fee. In all cases
8instituted by the the Illinois Department on behalf of a child
9or spouse, other than one receiving a grant of financial aid
10under Article IV, on whose behalf an application has been made
11and approved for child support enforcement services as
12provided by Section 10-1, the court shall impose a collection
13fee on the individual who owes a child or spouse support
14obligation in an amount equal to 10% of the amount so owed as
15long as such collection is required by federal law, which fee
16shall be in addition to the support obligation. The imposition
17of such fee shall be in accordance with provisions of Title IV,
18Part D, of the Social Security Act and regulations duly
19promulgated thereunder. The fee shall be payable to the clerk
20of the circuit court for transmittal to the Illinois
21Department and shall continue until child support enforcement
22services are terminated by the Department.
