SYNOPSIS AS INTRODUCED:

625 ILCS 5/3-835 new

    Amends the Illinois Vehicle Code. Provides a $5 discount for vehicles of the first divisions and Class B vehicles of the second division if the registration payment is made online. Restricts the Secretary of State from charging an additional fee for registration fee payments made by a credit card, debit card, or other electronic means for persons renewing their vehicle registration online.

1    AN ACT concerning transportation.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Illinois Vehicle Code is amended by
5changing Section 3-806 and 3-815 and by adding Section 3-835
6as follows:
 
7    (625 ILCS 5/3-806)  (from Ch. 95 1/2, par. 3-806)
8    Sec. 3-806. Registration Fees; Motor Vehicles of the First
9Division. Every owner of any other motor vehicle of the first
10division, except as provided in Sections 3-804, 3-804.01,
113-804.3, 3-805, 3-806.3, 3-806.7, and 3-808, and every second
12division vehicle weighing 8,000 pounds or less, shall pay the
13Secretary of State an annual registration fee at the following
14rates:

6    Beginning with the 2025 registration year, a $5 discount
7shall be applied to the registration fee of a motor vehicle of
8the first division if the payment is made online.
9    A $1 surcharge shall be collected in addition to the above
10fees for motor vehicles of the first division, autocycles,
11motorcycles, motor driven cycles, and pedalcycles to be
12deposited into the State Police Vehicle Fund.
13    All of the proceeds of the additional fees imposed by
14Public Act 96-34 shall be deposited into the Capital Projects
15Fund.
16    A $2 surcharge shall be collected in addition to the above
17fees for motor vehicles of the first division, autocycles,
18motorcycles, motor driven cycles, and pedalcycles to be
19deposited into the Park and Conservation Fund for the
20Department of Natural Resources to use for conservation
21efforts. The monies deposited into the Park and Conservation
22Fund under this Section shall not be subject to administrative
23charges or chargebacks unless otherwise authorized by this
24Act.
25    Of the fees collected for motor vehicles of the first
26division other than Autocycles, Motorcycles, Motor Driven

1Cycles, and Pedalcycles, $1 of the fees shall be deposited
2into the Secretary of State Special Services Fund and $49 of
3the fees shall be deposited into the Road Fund.

6    Sec. 3-815. Flat weight tax; vehicles of the second
7division.
8    (a) Except as provided in Section 3-806.3 and 3-804.3,
9every owner of a vehicle of the second division registered
10under Section 3-813, and not registered under the mileage
11weight tax under Section 3-818, shall pay to the Secretary of
12State, for each registration year, for the use of the public
13highways, a flat weight tax at the rates set forth in the
14following table, the rates including the $10 registration fee:

12    Beginning with the 2025 registration year, a $5 discount
13shall be applied to the registration fee of vehicles in the
148,000 lbs. and less flat weight plate category above if the
15payment is made online.
16    Beginning with the 2010 registration year, a $1 surcharge
17shall be collected for vehicles registered in the 8,000 lbs.
18and less flat weight plate category above to be deposited into
19the State Police Vehicle Fund.
20    Beginning with the 2014 registration year, a $2 surcharge
21shall be collected in addition to the above fees for vehicles
22registered in the 8,000 lb. and less flat weight plate
23category as described in this subsection (a) to be deposited
24into the Park and Conservation Fund for the Department of
25Natural Resources to use for conservation efforts. The monies
26deposited into the Park and Conservation Fund under this

1Section shall not be subject to administrative charges or
2chargebacks unless otherwise authorized by this Act.
3    Of the fees collected under this subsection, $1 of the
4fees shall be deposited into the Secretary of State Special
5Services Fund and $99 of the fees shall be deposited into the
6Road Fund.
7    All of the proceeds of the additional fees imposed by
8Public Act 96-34 shall be deposited into the Capital Projects
9Fund.
10    (a-1) A Special Hauling Vehicle is a vehicle or
11combination of vehicles of the second division registered
12under Section 3-813 transporting asphalt or concrete in the
13plastic state or a vehicle or combination of vehicles that are
14subject to the gross weight limitations in subsection (a) of
15Section 15-111 for which the owner of the vehicle or
16combination of vehicles has elected to pay, in addition to the
17registration fee in subsection (a), $125 to the Secretary of
18State for each registration year. The Secretary shall
19designate this class of vehicle as a Special Hauling Vehicle.
20    (a-5) Beginning January 1, 2015, upon the request of the
21vehicle owner, a $10 surcharge shall be collected in addition
22to the above fees for vehicles in the 12,000 lbs. and less flat
23weight plate categories as described in subsection (a) to be
24deposited into the Secretary of State Special License Plate
25Fund. The $10 surcharge is to identify vehicles in the 12,000
26lbs. and less flat weight plate categories as a covered farm

1vehicle. The $10 surcharge is an annual, flat fee that shall be
2based on an applicant's new or existing registration year for
3each vehicle in the 12,000 lbs. and less flat weight plate
4categories. A designation as a covered farm vehicle under this
5subsection (a-5) shall not alter a vehicle's registration as a
6registration in the 12,000 lbs. or less flat weight category.
7The Secretary shall adopt any rules necessary to implement
8this subsection (a-5).
9    (a-10) Beginning January 1, 2019, upon the request of the
10vehicle owner, the Secretary of State shall collect a $10
11surcharge in addition to the fees for second division vehicles
12in the 8,000 lbs. and less flat weight plate category
13described in subsection (a) that are issued a registration
14plate under Article VI of this Chapter. The $10 surcharge
15shall be deposited into the Secretary of State Special License
16Plate Fund. The $10 surcharge is to identify a vehicle in the
178,000 lbs. and less flat weight plate category as a covered
18farm vehicle. The $10 surcharge is an annual, flat fee that
19shall be based on an applicant's new or existing registration
20year for each vehicle in the 8,000 lbs. and less flat weight
21plate category. A designation as a covered farm vehicle under
22this subsection (a-10) shall not alter a vehicle's
23registration in the 8,000 lbs. or less flat weight category.
24The Secretary shall adopt any rules necessary to implement

26    (b) Except as provided in Section 3-806.3, every camping

1trailer, motor home, mini motor home, travel trailer, truck
2camper or van camper used primarily for recreational purposes,
3and not used commercially, nor for hire, nor owned by a
4commercial business, may be registered for each registration
5year upon the filing of a proper application and the payment of
6a registration fee and highway use tax, according to the
7following table of fees:

23    Every house trailer must be registered under Section
243-819.
25    (c) Farm Truck. Any truck used exclusively for the owner's
26own agricultural, horticultural or livestock raising

1operations and not-for-hire only, or any truck used only in
2the transportation for-hire of seasonal, fresh, perishable
3fruit or vegetables from farm to the point of first
4processing, may be registered by the owner under this
5paragraph in lieu of registration under paragraph (a), upon
6filing of a proper application and the payment of the $10
7registration fee and the highway use tax herein specified as
8follows:

25    Of the fees collected under this subsection, $1 of the

1Services Fund and $99 of the fees shall be deposited into the
2Road Fund.
3    In the event the Secretary of State revokes a farm truck
4registration as authorized by law, the owner shall pay the
5flat weight tax due hereunder before operating such truck.
6    Any combination of vehicles having 5 axles, with a
7distance of 42 feet or less between extreme axles, that are
8subject to the weight limitations in subsection (a) of Section
915-111 for which the owner of the combination of vehicles has
10elected to pay, in addition to the registration fee in
11subsection (c), $125 to the Secretary of State for each
12registration year shall be designated by the Secretary as a
13Special Hauling Vehicle.
14    (d) The number of axles necessary to carry the maximum
15load provided shall be determined from Chapter 15 of this
16Code.
17    (e) An owner may only apply for and receive 5 farm truck
18registrations, and only 2 of those 5 vehicles shall exceed
1959,500 gross weight in pounds per vehicle.
20    (f) Every person convicted of violating this Section by
21failure to pay the appropriate flat weight tax to the
22Secretary of State as set forth in the above tables shall be
23punished as provided for in Section 3-401.
