SYNOPSIS AS INTRODUCED:
 
430 ILCS 15/6.2 new

    Amends the Gasoline Storage Act. Provides that, if a leak of petroleum, a petroleum product, a hazardous substance, or a regulated substance occurs from an underground storage tank regulated by the Act and if the leak results in injury to any person or damage to any person's property, then the owner of the underground storage tank is strictly liable in civil damages to the person for the full amount of the injury or property damage proximately caused by the leak.

1    AN ACT concerning safety.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Gasoline Storage Act is amended by adding
5Section 6.2 as follows:
 
6    (430 ILCS 15/6.2 new)
7    Sec. 6.2. Strict liability for injury or damage resulting
8from underground storage tank leak. If a leak of petroleum, a
9petroleum product, a hazardous substance, or a regulated
10substance occurs from an underground storage tank regulated by
11this Act or rules adopted under this Act and if the leak
12results in injury to any person or damage to any person's
13property, then the owner of the underground storage tank is
14strictly liable in civil damages to the person for the full
15amount of the injury or property damage proximately caused by
16the leak.
