SYNOPSIS AS INTRODUCED:
 
415 ILCS 5/22.40c new

    Amends the Environmental Protection Act. Provides gas collection and control system requirements for municipal solid waste landfills, including requirements for gas to be collected from each area in which solid waste has been in place for at least one year, for gas to be drawn toward the gas control devices, for a gas collection and control system to be installed within 12 months of reaching certain thresholds, for gas collection and control design plans to provide for alternative preliminary measures, and for the methane destruction efficiency of flared systems to reach 99%.

1    AN ACT concerning safety.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Environmental Protection Act is amended by
5adding Section 22.40c as follows:
 
6    (415 ILCS 5/22.40c new)
7    Sec. 22.40c. Gas Collection and Control System
8Requirements. Each owner or operator of a municipal solid
9waste landfill that meets 40 CFR 60.33c and relevant federal
10regulatory requirements to install a gas collection and
11control system must fulfill the following requirements:
12        (1) The owner or operator must, in the case of an
13    active municipal solid waste landfill, operate the gas
14    collection and control system so that gas is collected
15    from each area, cell, or group of cells in the municipal
16    solid waste landfill in which solid waste has been in
17    place for one year or more.
18        (2) The owner or operator must estimate when the
19    landfill will reach the thresholds identified in 40 CFR
20    60.33c and relevant federal regulatory requirements
21    requiring installation of a gas collection and control
22    system, install a gas collection and control system within
23    12 months after that estimated date, and operate the gas

1    collection and control system in accordance with 40 CFR
2    60.34f.
3        (3) The gas collection and control design plan must
4    provide for whether other measures to control gas,
5    including horizontal collectors, connections to the
6    leachate control system, and electric systems that will
7    eventually connect to control devices, the vacuum system,
8    and other gas collection and control system elements, can
9    be installed before the full gas collection and control
10    system is required.
11        (4) The gas collection and control system, if it uses
12    a flare, must achieve a methane destruction efficiency of
13    at least 99% by weight.
14        (5) The gas collection system must be designed and
15    operated to draw all the gas toward the gas control device
16    or devices.
