SYNOPSIS AS INTRODUCED:
 
20 ILCS 3125/16 new

    Amends the Energy Efficient Building Act. Requires the Board to adopt rules requiring all buildings to be designed and constructed to provide natural gas service and electric power. Species that a unit of local government may not enact or enforce a resolution, ordinance, rule, code, or policy, or take any other action that restricts or prohibits or has the effect of restricting or prohibiting the type of fuel source or source of energy production that may be used, delivered, converted, or supplied by a natural gas utility. Limits home rule powers.

1    AN ACT concerning State government.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Energy Efficient Building Act is amended by
5adding Section 16 as follows:
 
6    (20 ILCS 3125/16 new)
7    Sec. 16. Energy requirements.
8    (a) The Board shall adopt rules requiring all buildings to
9be designed and constructed to provide natural gas service and
10electric power.
11    (b) A unit of local government may not enact or enforce a
12resolution, ordinance, rule, code, or policy, or take any
13other action that restricts or prohibits or has the effect of
14restricting or prohibiting the type of fuel source or source
15of energy production that may be used, delivered, converted,
16or supplied by a natural gas utility.
17    (c) A unit of local government, including a home rule
18unit, may not restrict or prohibit access to a fuel source or
19to a source of energy production in a manner that is
20inconsistent with this Section. This Section is a limitation
21under subsection (i) of Section 6 of Article VII of the
22Illinois Constitution on the concurrent exercise by home rule
23units of powers and functions exercised by the State.
