SYNOPSIS AS INTRODUCED:

40 ILCS 5/14-103.41

Amends the State Employees Article of the Illinois Pension Code. Adds to the definition of "Tier 1 member", a member who was employed by the State in any capacity for which the member may purchase service credit under the Article and that employment began before January 1, 2011, notwithstanding whether that member first became a member on or after January 1, 2011. Effective immediately.

AN ACT concerning public employee benefits.

Be it enacted by the People of the State of Illinois, represented in the General Assembly:

Section 5. The Illinois Pension Code is amended by changing Section 14-103.41 as follows:

(40 ILCS 5/14-103.41)

Sec. 14-103.41. Tier 1 member. "Tier 1 member": A member of this System who (1) first became a member or participant before January 1, 2011 under any reciprocal retirement system or pension fund established under this Code other than a retirement system or pension fund established under Article 2, 3, 4, 5, 6, or 18 of this Code or (2) was employed by the State in any capacity for which the member may purchase service credit under this Article and that employment began before January 1, 2011, notwithstanding whether that member first became a member on or after January 1, 2011.

Section 99. Effective date. This Act takes effect upon becoming law.
