SYNOPSIS AS INTRODUCED:
 
235 ILCS 5/6-24a  from Ch. 43, par. 139a

    Amends the Liquor Control Act of 1934. In a provision requiring retail licensees to post a sign with a specified message concerning the risk of birth defects, removes a provision directing individuals who need assistance for substance abuse to call the Office of Alcoholism and Substance Abuse. Provides that the sign shall be no less than (instead of no larger than) 8 1/2 inches by 11 inches.

1    AN ACT concerning liquor.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Liquor Control Act of 1934 is amended by
5changing Section 6-24a as follows:
 
6    (235 ILCS 5/6-24a)  (from Ch. 43, par. 139a)
7    Sec. 6-24a. Display of birth defects warning signs.
8    (a) The General Assembly finds that there is a need for
9public information about the risk of birth defects
10(specifically Fetal Alcohol Syndrome) when women consume
11alcoholic liquor during pregnancy. The United States Surgeon
12General has recommended abstinence from alcohol during
13pregnancy. Since Fetal Alcohol Syndrome and fetal alcohol
14effects are preventable, the General Assembly finds that it is
15in the public interest to provide warning about the risk of
16alcohol-related birth defects at places where alcoholic
17liquors are sold.
18    (b) Every holder of a retail license, whether the licensee
19sells or offers for sale alcoholic liquors for use or
20consumption on or off the retail license premises, shall cause
21a sign with the message "GOVERNMENT WARNING: ACCORDING TO THE
22SURGEON GENERAL, WOMEN SHOULD NOT DRINK ALCOHOLIC BEVERAGES
23DURING PREGNANCY BECAUSE OF THE RISK OF BIRTH DEFECTS. IF YOU

2ALCOHOLISM AND SUBSTANCE ABUSE (OASA) AT 1-800-843-6154." to
3be framed and hung in plain view. These signs shall be no less
4larger than 8 1/2 inches by 11 inches.
5    (c) In the event there is no warning sign posted on the
6retailer's premises, it shall be the responsibility of the
7Illinois Liquor Control Commission to furnish the retailer
8with a warning sign. The retailer shall have 30 days from
9receipt of the warning sign to post it on the licensed
10premises. Thereafter, a retailer who violates this Section is
11subject to a written warning for the first violation. For a
12second or subsequent violation, the retailer shall pay a fine
13of at least $20 but not more than $100 for each such violation.
14For the third and subsequent violations, each day the activity
15continues shall be a separate violation.
